Mr. Senzee stated approval by the Planning and Zoning Commission for a 12 month extension for <br /> <br />White Sands Square, located at 960 Belle Avenue would be based on the revised site plan dated May 21, 2008, the <br /> <br />findings of fact and conclusions of the staff report dated April 6, 2007, the staff's letter dated April 14, 2009 and the <br /> <br />revised conditions as stated in the staff report which were: <br /> <br />1. Prior to the issuance of a Certificate of Occupancy for the proposed structure, the applicant shall make <br />a contribution of $7,500 to the Casselberry Tree Bank. The applicant may choose to submit a revised <br />landscape plan to Community Development staff indicating the addition of 30 trees to the site in lieu of <br />this contribution. This revised landscape plan shall meet the requirements of Article XIII and shall <br />receive Community Development approval prior to a final landscape inspection. <br />2. All proposed and future lighting must comply with Chapter 3, Article X, Section 3-10.2 (6) of the Land <br />Development Regulations. <br />3. The site shall pass a photometric inspection prior to the issuance of a Certificate of Occupancy. <br />4. All signage for the site shall conform to the City's ULDR and shall be submitted as a separate building <br />permit. <br />5. All permits from appropriate State and County agencies shall be obtained prior to the submittal for a site <br />engineering permit to the City's Public Works Department. <br />6. No site engineering construction activities shall take place on the property until a site permit is <br />reviewed, approved, and issued by the City's Public Works Department. <br />7. The site plan extension shall be valid for twelve months upon approval by the Planning and Zoning <br />Commission. The site plan shall expire on Apri/11, 2010. <br />8. All of the above conditions shall be fully and faithfully executed or the site plan shall become null and <br />void. <br /> <br />The applicant was not present at the meeting. <br /> <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br /> <br />to, the request. No one came forward <br /> <br />A brief discussion ensued regarding the granting of extensions. Mr. Parkhurst asked for a motion to <br /> <br />address SPR 09-03. Mr. Aramendia recommended approval of SPR 09-03 White Sand Square at 960 Belle Avenue <br /> <br />based on staff report dated April 14, 2009 from Mr. Senzee to the Planning and Zoning Commission as stated. Mr. <br /> <br />Weinroth seconded the motion. The motion passed unanimously by voice vote. <br /> <br />Fourth Item of Business: CU 09-04: 1870 State Road 436. Conditional use request to utilize a portion of an <br />existing restaurant's building and parking lot for automotive sales within the CG zoning district. <br /> <br />Mr. Charles Senzee, Planner, stated that the applicant has requested this item be continued to a later date <br /> <br />to allow him time to reevaluate his plans in order to address staff's concerns. Mr. Parkhurst asked for a motion to <br /> <br />address CU 09-04. Mr. Aramendia made a motion to recommend continuing the consideration of CU 09-04 to a later <br /> <br />date. Mr. Weinroth seconded the motion. The motion passed unanimously by voice vote. <br />
