<br />2. The "Lancelot" Property is more fully described as follows: <br /> <br />Lot 3, BLK E, CAMELOT UNIT ONE according to the plat <br />thereof, as recorded in Plat Book 15, Page 83 and 84, Public <br />Records of Seminole County, Florida <br /> <br />3. John Casselberry agrees to pay the CITY, by July 20, 2009, the sum of SIX <br /> <br />THOUSAND NINE HUNDRED THIRTY SEVEN DOLLARS AND 93/100 ($6,937.93) in full and <br /> <br />complete satisfaction of Count II of the lawsuit. John Casselberry acknowledges that this payment <br /> <br />will not satisfy all the attorney's fees incurred in the lawsuit, which must be paid in full before <br /> <br />settlement of the remaining Count I, to include all of the attorneys' fees incurred. <br /> <br />4. <br /> <br />Upon payment of said sum, the CITY shall release the code enforcement lien <br /> <br />on Lancelot and exempt the Lancelot propelty from the enforcement of the "Queens Mirror" lien as it <br /> <br />may apply to all property owned by John Casselberry in Seminole County, Florida. Releases shall <br /> <br />then be filed upon the public records of Seminole County, Florida, and a dismissal of Count II of the <br /> <br />Lawsuit, with prejudice shall be filed. <br /> <br />5. <br /> <br />In the event it becomes necessary to construe or enforce any provision ofthis <br /> <br />Agreement, the prevailing party shall be entitled to recover from the other party its reasonable <br /> <br />attorneys' fees and costs, which shall include attorneys' fees incurred at both the trial and appellate <br /> <br />levels and subsequent to the entry of a judgment should a judgment be placed with an attorney for <br /> <br />collection. It is also agreed that this Agreement shall be governed by the laws of the State of Florida <br /> <br />and that the venue of any legal proceedings to enforce or construe this Agreement shall be in <br /> <br />Seminole County, Florida. <br /> <br />6. Counterparts. This Agreement may be executed in any number of counterparts, each <br /> <br />of which shall be deemed an original, but all of which, taken together shall constitute. one and the <br /> <br />2 <br />
