<br />RESOLUTION 09-2051 <br /> <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE EXECUTION OF A SE'ITLEMENT AGREEMENT <br />BETWEEN JOHN CASSELBERRY AND THE CITY OF CASSELBERRY, <br />REGARDING THE FORECLOSURE OF A CODE ENFORCEMENT LIEN <br />ON 1140 LANCELOT WAY; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Casselberry filed a foreclosure action entitled City of Casselberry <br />v. John Casselberry, Case No. 2009-CA-1806-14-L, pertaining to code enforcement liens against <br />John Casselberry relating to his two properties with an address of 535 Queens Mirror, and 1140 <br />Lancelot Way; and <br /> <br />WHEREAS, the City of Casselberry wishes to resolve Count II of the Complaint as it <br />pertains to a code enforcement lien against John Casselberry on the property known as 1140 <br />Lancelot Way; and <br /> <br />WHEREAS, John Casselberry and the City of Casselberry have come to a mutually <br />agreeable resolution to the foreclosure action as it pertains to 1140 Lancelot Way only; and <br /> <br />WHEREAS, the City of Casselberry intends to continue prosecuting the foreclosure action <br />as it pertains to Count I, pertaining to 535 Queens Mirror Circle property. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION L The City Commission of the City of Casselberry hereby authorizes the <br />Mayor to execute the Settlement Agreement attached hereto as Exhibit "A," as it pertains to the <br />1140 Lancelot Way code enforcement lien. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of <br />the provisions of this Resolution are hereby repealed. <br /> <br />SECTION m. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
