Planning & Zoning Commission( <br />Local Planning Agency <br />April 8.2009 <br />Page 5 <br />Mr. Lauritsen said that there are no two story buildings in the area and expressed a privacy concern. He <br />also expressed a concern with animals removing trash from dumpsters, lighting intrusion on the adjacent parcels and <br />the tune frame for the public meeting notification. Mr. Lauritsen felt that this development would not have any <br />positive value on their neighborhood. <br />hz response to the Commission's question, Mr. Benzes explained that notification letters were sent to the <br />Mr. Benzes stated that a conceptual plan has been provided; however, a site plan has not been su~-~~ <br />for review. He said there will be a 40 foot buffer, He said based on this plan there will be a ~ 60 foot buffer t '° °~ <br />the property line and the assisted living facility building. He said a wall could be required. <br />A general discussion ensued regarding the lighting code, buffering and medical waste. <br />In response to the Commission's concern, Ms. Drags stated that the zoning is office/residential and the <br />future land use is commercial Nis. Drags said tonight's item is addressing a future land use amendment to the <br />Camprehensive Flan and not to the zoning of the property. Ms. Smith reviewed the permifited and conditional uses <br />for the officelresidential zoning designation. <br />A brief discussion ensued regarding the authority of Code Enforcement to inspeet property and the <br />previausly proposed townhome development for the site. Mr. Parkhurst asked for a motion to address LPA 09-01. <br />Mr. Van Meter made a motion recommending approval of LPA 09-Ot to the City Commission based on the staff <br />report dated April 3, 2409 and the findings of fact and conclusions of law, Mr. VonLangen seconded the motion. <br />The Board was polled. <br />Anthony Aramendia Yes <br />f~athan Van Meter Yes <br />Harley Parkhurst Yes <br />John VonLangen Yes <br />The motion passed unanimously. <br />
