Collection of costs. exoenses anft Denallies: liens UDon remedied Drooerty. <br /> <br />(a) After the Citv has caused the nuisance condition on orooertv to be remedied. the <br />Chief of Police or the Finance Director shall certifv the exoenses incurred bv the Citv in <br />remedvina the nuisance condition. all charaes necessarv to cover the Citv's <br />administrative exoenses. and anv administrative oenalties as orovided in this division. <br /> <br />(b) Said sum certified to be oaid to the Citv sh~l) become due and oavable bv the <br />orooertv owner within 30 davs of the date of the certification. <br /> <br />(c) In the event that the orooertv owner fa.ils or refuses to oav the said certifil;ld sum a <br />lien and soecial assessment shall be made uoon the orooertv which shall be oavable <br />with interest at the highest lawful rate of interest oer annum from the date of such <br />certification until oaid. <br /> <br />(d) Such lien shall be enforceable in the same manner as a iudament or tax lien in <br />favor of the Citv of Casselberrv. and shall constitute a first orioritv assessment lien <br />aaainst the affected orooertv. suoerior to all liens exceot for anv lien for taxes. and mav <br />be satisfied at anv time bv oavment thereof includina. but not limited to. anv and all <br />accrued interest. Notice of such lien sl}all be filed bv the Citv in the oublic records <land <br />records) of Seminole Countv Florida. <br /> <br />(e) If the subiect orooertv is secured bv locks or otherwise. the Citv shall have the <br />authoritv to enter said property for pUrPoses of remedyinG the condition causina the <br />nuisance or violation. and anv additional costs incurred bv the Citv in aaininG access to <br />the orooertv. includinG but not limited to. iudicial action. or in re-securina the orooertv <br />after c1eanina and i;:learina shall be considered exoenses of remedvina the condition. <br /> <br />VI. Adminl.trative charaes: adminl.tratlve oenaltles. <br /> <br />(a) In addition to the actual cost of remedyinG the nuisance cited under this divij?ion. <br />the Citv shall also assess a charGe to cover the administrative exoenses incurred bv the <br />Citv in securina and monitorinG the orooertv. includinG the costs for the services of a <br />orivate contractor or the Citv's forces to remedy the nuisance. <br /> <br />(b) The schedule of said administrative charaes shall be reviewed and aooroved bv <br />Citv Manaaer or desianee at least on an annual basis <br /> <br />(c) If a second violation of this Dart of th,is division is cited aGainst the same orooertv <br />and orooertv owner within 12 months from the date of the first cilalion. an administratiy~ <br />oenaltv of $100.00 shall additionally be assessed bv the City five davs after the second <br />citation. If the condition is abated bv the owner durinG the five dav oeriod, the penalty <br />will not be assessed. If a third violation of this Dart of this division is cited aaainst the <br />same orooertv and orooertv owner within 12 months from the date of the first citation. <br />an administrative oenaltv of $200.00 shall additionally be assessed bv the Citv five davs <br />after the third citation.
