<br />ORDINANCE NO. 08-1237 <br /> <br />AN ORDINANCE AMENDING CERTAIN PROVISIONS OF <br />ARTICLE XVI OF THE CITY OF CASSELBERRY UNIFIED <br />LAND DEVELOPMENT REGULATIONS RELATING TO <br />SIGNS; AMENDING SECTION 3-16.2, DEFINITIONS, TO <br />REVISE DEFINITION OF ANIMATED SIGNS AND TO ADD <br />A DEFINITION FOR ELECTRONIC DISPLAY TYPE <br />SIGNS; AMENDING SECTION 3-16.8, PROHIBITED <br />SIGNS, TO PROHIBIT SIGNS WITH DISTRACTING <br />LIGHTING; AMENDING 3-16.9 TO CLARIFY <br />PROHIBITION ON INCREASES IN NON-CONFORMING <br />SIGNS, AND TO PROVIDE AN AMORTIZATION <br />SCHEDULE; REPEALING SECTIONS 3-16.7(D) AND 3- <br />16.10(G), AND RENUMBERING 3-16.7(E); ADDING <br />SECTION 3-16.13, APPEALS TO BOARD OF <br />ADJUSTMENT; SECTION 3-16.14, APPELLATE <br />DECISIONS DEEMED FINAL, SUBJECT TO REVIEW; <br />SECTION 3-16.15, SUBSTITUTION OF NON- <br />COMMERCIAL SPEECH FOR COMMERCIAL SPEECH; <br />SECTION 3-16.16, CONTENT NEUTRALITY AS TO SIGN <br />MESSAGE; 3-16.17, SEVERABILITY; AND PROVIDING <br />FOR SEVERABILITY, CODIFICATION, CONFLICTS AND <br />AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission of the City of Casselberry has determined the <br />need to update and revise its Unified Land Development Regulations relative to signs; <br />and <br /> <br />WHEREAS, the City Commission wishes to ensure that the City's Unified Land <br />Development Regulations as it relates to signs is in compliance with all constitutional <br />and other legal requirements; and <br /> <br />WHEREAS, the City Commission wishes to continue to prohibit certain sign <br />types, including billboards; and <br /> <br />WHEREAS, the City Commission finds and determines that certain types of <br />signs, particularly large signs and signs with lighted and/or changing information, create <br />a safety hazard by distracting motorists, pedestrians, and others; and <br /> <br />WHEREAS, the City Commission wishes to protect the safety of motorists, <br />pedestrians, and others from distraction caused by signs; and <br /> <br />WHEREAS, the City Commission finds that some signs, particularly large signs <br />and signs with lighted and/or changing information, detract from the aesthetic beauty of <br />the landscape; and <br /> <br />Ordinance No. 08-1237 <br />Page 1 <br />
