RESOLUTION 08-1989 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTIIORlZlNG THE EXECUTION OF CHANGE ORDER NO, 1 TO THE CONTRACTUAL AGREEMENT Wlm EMERAI.D UTILITIES AND SITE DEVELOPMENT FOR EXTENSION OF THE NATURAL RESOURCES CONSERV A nON SERVICES EROSION CONTROL PROJECT AS A RESULT OF TROPICAL STORM FAY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECI'IVE DATE." WHEREAS, the City WllSIlWlll"lled funding for five separllte erosion control area projects as a result of Tropical Storm Fay by the Natural Resources Conservation Services (NRCS); and WHEREAS, of the live said projects, Emerald Utilities and Site Development (Emerald) was awarded the contract to construct foul' (the Gee Creek Weir Replacement, Queens Mirror- South Lake Triplet Channel Erosion Control Project, North Lake Triplet Channel Erosion Control Project and the North Winter Park Drive Bridge Erosion Control Pr~icct); and WHEREAS, the project limits for the Queens Mirror South Lake Triplet arca 'vcre originally established by the Public Works Department and NRCS; and WHEREAS, the Public Worlcs Department in concurrence with NRCS has determined that the extension of the Queens MilTor South Lake Triplet portion of the NRCS project would further alleviate the pervasive erosion experienced along the northern portion of the canal; and W"HEREAS, Emerald submitted Change Order No. I to the ccntractual agrccmcntto cover thc unit costs associated with the additional work required to complete the new projeet limits; and WlIEREAS, the Public Works Department has reviewcd the Change Order submitted by Emerald in the lI111.ount 0[$1 04,925.00, and finds it acceptable, responsive and adequate to meet the requirements of the City., NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission of the City of Casselberry hereby approves Change Order No. I to the contract ~ith Emerald Utilities and Site Development for the extension ofNRCS repsir of Queens Mirror South Lake Triplet, attached as "Exhibit A", and authorizes the Mayor to execute said docunlcnt on behalf of the City. SECTION n. Conflicts. All Rcsolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed.
