<br />COMMERCIAL WASTE CONTAINERS, HAULING AND DISPOSAL <br />FOR THE CITY OF CASSELBERRY FACILITIES <br /> <br />Tms AGREEMENT made and entered into this _ day of December, 2008 between <br /> <br />the City of Casselberry, Florida, whose address is 95 Triplet Lake Drive, Casselberry, FL 32707 <br /> <br />(hereinafter referred to as "City") and CONTAINER RENTAL COMPANY, INC.., authorized <br /> <br />to conduct business in Florida, whose address is 2715 Staten Road, Orlando, Florida 32804 <br /> <br />(hereinafter referred to as "Contractor"). <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the City desires to retain the services of a competent and qualified <br /> <br />contractor to provide Commercial Waste Containers, Hauling and Disposal to the eight (8) City <br /> <br />owned facilities; and <br /> <br />WHEREAS, Contractor is competent and qualified to provide Commercial Waste <br /> <br />Containers, Hauling and Disposal to the eight (8) City owned facilities in the City, and desires to <br /> <br />provide its professional services according to the terms and conditions outlined herein; and <br /> <br />NOW THEREFORE, for and in consideration of the mutual benefits to flow from each <br /> <br />to the other, the parties herein agree as follows: <br /> <br />Section 1. Definitions. To the extent the definitions contained herein conflict with <br /> <br />similar definitions contained in any Federal, State, or local law, the definitions herein shall <br /> <br />prevail. However, nothing contained herein shall be intetpreted to require Contractor to <br /> <br />undertake any conduct which is contrary to Federal, State, or local law.
