<br />RESOLUTION 08-1972 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA <br />APPROVING AND AUTHORIZING THE EXECUTION OF A LOCAL <br />AGENCY PROGRAM AGREEMENT WITH THE FLORIDA <br />DEPARTMENT OF TRANSPORTATION FOR FUNDING OF THE <br />DESIGN OF THE WIRZ TRAIL PHASE I (KEWANNEE TRAIL <br />CONNECTOR); PROVIDING FOR CONFLICTS, SEVERABILITY AND <br />EFFECTIVE DATE." <br /> <br />WHEREAS, trail systems are a valuable asset to the vibrancy of a community providing <br />outlets and opportunities for both recreation and transportation; and <br /> <br />WHEREAS, trail systems provide an economic benefit to cities and neighborhoods <br />where trails exist and are a significant element of the City of Casselberry's Comprehensive Plan; <br />and <br /> <br />WHEREAS, THE Florida Department of Transportation has funding available for design <br />services of the Wirz Trail Phase I (Kewannee Trail Connector) for development of the bike trail <br />systems within the incorporated areas of the City and connect to Seminole County's Kewannee <br />Trail; and <br /> <br />WHEREAS, the City desires to enter into the Local Agency Program Agreement with <br />the Florida Department of Transportation for funding the design of the Wirz Trail Phase I. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Local Agency Program Agreement for design of the Wirz Trail Phase I (Kewannee Trail <br />Connector) with the Florida Department of Transportation (attached as Exhibit "A") and <br />authorizes the Mayor to execute said document on behalf of the City <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION m. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
