<br />public agency's acquisition. Waivers, exceptions or variances shall: <br /> <br />a. Provide at least seventy percent (70%) of the required parking. <br />b. Maintain at least fifty percent (50%) of the required front yard. <br />c. Provide, at the minimum, a five foot (5') street front landscape <br />strip. The landscape material provided shall be appropriate for <br />the planting area and the overall site. <br />d. Maintain the existing on-site drainage and retention and strive <br />to meet the minimum requirements of the St. Johns River <br />Water Management District. <br />Any further expansion or enlargement thereof shall be in accordance <br />with all applicable code requirements. <br /> <br />(2) Existing characteristics of use which become nonconforming or <br />increase in nonconformity as a result of a taking, including but not <br />limited to, minimum lot size, setbacks, open space, off-street parking, <br />landscape requirements, drainage and retention shall be required to <br />meet code requirements to the greatest extent possible, to the <br />satisfaction of the Administrative Official or designee. Thereafter, the <br />existing characteristics of use shall be deemed conforming only to <br />the extent of those nonconformities caused by the governmental or <br />public agency's acquisition. Waivers, exceptions or variances shall <br />not exceed a thirty percent (30%) reduction of the required parking <br />standard, fifty percent (50%) reduction in the required front yard, <br />elimination of the street front landscape strips, or reduction in <br />drainage and retention that does not meet the minimum <br />requirements of the St. Johns River Water Management District. Any <br />further expansion or enlargement thereof shall be in accordance with <br />all applicable code requirements. <br /> <br />(2) In granting any waiver or exception to code requirements, the <br />Administrative Official or designee shall, in conjunction with the <br />appropriate experts, determine that the requested waiver or <br />exception: <br /> <br />a. Will not adversely affect visual, safety, aesthetic or <br />environmental concerns of neighborhood properties. <br /> <br />b. Will not adversely affect the safety or pedestrians or <br />operations of motor vehicles. <br /> <br />c. Will preserve code-required off-street parking requirements to <br />the greatest extent practicable. The reconfiguration, reduction, <br />or removal of landscape and/or open space requirements may <br />be considered to preserve off-street parking. <br /> <br />Ordinance 08-1250 <br />Page 3 <br />
