<br />CASSELBERRY CITY COMMISSION <br />Minutes of October 13, 2008 - Regular Meeting <br />Page 12 of17 <br /> <br />Attorney has reviewed and approved the content of the ordinance. The Planning and Zoning Commission <br />recommended approval of Ordinance 08-1250 by a 6 - I vote at their September 10, 2008 meeting. <br /> <br />Budget Impact: This item has no impact to the budget. <br /> <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 08-1250 on first reading. <br /> <br />Public Hearing: The following individual came forward and addressed Ordinance 08-1249: <br /> <br />I) Mr. John Casselberry, 700 South Lost Lake Lane, voiced concerns about how technically <br />non-conforming properties are handled currently. <br /> <br />No one else came forward. Mayor Goff closed the public hearing relative to Ordinance 08-1249. <br /> <br />MOTION: Commissioner Solomon moved to approve Ordinance <br />08-1250 on first reading as presented. Motion was <br />seconded by Commissioner Doerner. <br /> <br />DISCUSSION: Commissioner Doerner requested that the Florida Department of <br />Transportation representative give clarification as to the benefits of <br />implementing the criteria. Mr. Jim Ellicott, Appraiser from the Florida <br />Department of Transportation came forward and stated the criteria provides <br />flexibility to continue use of certain properties that do not require a total <br />taking for a public project. The ability of the City to provide certain <br />waivers, exceptions or variances to enable business or residential properties <br />to remain viable in conjunction with a public project affects the overall cost <br />of the public project and may determine whether or not the project can be <br />undertaken. Mr. Ellicott distributed copies of before and after photos of an <br />actual property in Orange County that utilized the recommended criteria. <br />Discussion ensued regarding severance to parking and impacts on the <br />commercial businesses due to some public projects. <br /> <br />Motion carried unanimously by voice vote 5 - O. <br /> <br />C. First Reading of Ordinance 08-1251 - "Glitch" Ordinance Amending the ULDR to <br />Clarify Various Sections of the Code <br /> <br />The City Clerk read Ordinance 08-1251 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />SELECTED SECTIONS OF THE CITY CODE OF ORDINANCES, PART III, UNIFIED <br />LAND DEVELOPMENT REGULATIONS, AMENDING SECTION 2-5.3, LAND USE <br />BY DISTRICTS, OF ARTICLE V, ZONING DISTRICT REGULATIONS, OF CHAPTER <br />II, DISTRICT AND GENERAL REGULATIONS, TO PROVIDE ADDITIONAL <br />
