<br />RELEASE AND HOLD HARMLESS AGREEMENT
<br />
<br />THAT I, THE UNDERSIGNED, , a private
<br />pcrson, as an induccment to thc City of Casselberry, Florida ("CITY"), and for and in
<br />consideration of the CITY's consent, to allow mc to enter onto CITY -owned property in order:

<br />and recognizing the inherent danger and risks in doing so, do hercby for myse)l~ my heirs,
<br />assigns, personal represcntatives, executors, administrators, and next of kin, agrce to aSSUme any
<br />and all risks, including but not limited to potential injuries, death or damaging event, which
<br />mayoccur in connection with my actions, and to release, waive, covenant not to sue, indemnify,
<br />hold harmless, and forever discharge the CITY, its officers, agents, employees, or assigns, from
<br />any and all liability, accident, claim, loss, lien, suit, demand, damage, or cause of action and
<br />expenses, including court costs and attorney's fces and other reasonable costs ("liabilities"),
<br />which may arise from or by any injury to any person or damage to any property, during or as a
<br />result of my actions.
<br />I understand that the CITY does not assume any such liabilities for harm, injury, or any
<br />damaging event which is directly or indirectly attributable to premise defccts or conditions, real
<br />or alleged, on the CITY -own cd property where entry has been consented to, which may now exist
<br />or which may hereafter arise upon said premises, responsibility for any and all such defects being
<br />expressly assumed by me.

<br />I furthcr understand and agree that the execution of this RELEASE shall apply to any
<br />such liabilities arising out of, or resulting from, my entry onto CITY -owned property, whether or
<br />not there is negligence on thc part of the CITY or any other person or entity. 1 further agree to
<br />indemnify, hold harmless and dcfend the CITY, its officers, agents, employees, or assigns, from
<br />any and all liabilities, which may arise out of, or result from, my actions, where such liabilities
<br />are caused by the sole negligence of the CITY or the joint negligence of the CITY and any other
<br />person or entity. It is my express intention that the indemnity provided for in this paragraph is
<br />indemnity by me to protect the CITY from the consequences of the CITY's own negligence,
<br />whether that negligence is the sole or a concurring cause of the liability.
