Resolution 08-1910 - SEMINOLA BOULEV ARD SANITARY SEWER UTILITY <br />EASEMENT AGREEMENTS AND RELATED BUDGET AMENDMENT #08-059 <br /> <br />The City Clerk read Resolution 08-1910 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF UTILITY EASEMENT(S) BETWEEN THE CITY OF CASSELBERRY <br />AND CASSELBERRY INVESTMENT PROPERTIES, LTD., DOROTHY H. SMITH, <br />VINCENT DEFILIPPO (CONTEMPORARY ASSETS, INC), MICHELE PASTERNACK, <br />MARIO AND KARON ZACCO, AND JOHN A. ZACCO (PROPERTY OWNERS ALONG <br />A SECOND OF SEMINOLA BOULEVARD) AND AUTHORIZING THE <br />POSTPONEMENT OF THE REMAINDER SECTIONS OF THE SEMINOLA <br />BOULEVARD SANITARY SEWER PROJECT; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Mr. Ed Torres made a presentation relating to Resolution 08-191 0 earlier in the meeting <br />which has been attached to and made a part of these minutes. Resolution 08-1910 provides approval for six <br />separate utility easement agreements between property owners along Seminola Boulevard and the City of <br />Casselberry for the construction of a section of the Seminola Boulevard Sanitary Sewer Project. Also <br />requested is a postponement of the remainder ofthe Seminola Boulevard Sanitary Sewer Project until all the <br />necessary easement agreements are acquired and the impact of other mandatory utility infrastructure financial <br />commitments are fully assessed. <br /> <br />Budget Impact: There is no direct budget impact for the execution of the utility easements presented with <br />the exception of the recording fees estimated at $20 per easement. However, as noted, the incentives <br />provided reduce the total amount of sewer connection and benefit fees that could be collected as well as <br />delay revenues from sanitary sewer service and/or flow-by charges. Nevertheless, the incentives are intended <br />as amicably negotiated and less costly acquisition than an outright purchase and/or acquisition by <br />condemnation via eminent domain. It is important to point out that the City has several outstanding <br />mandatory utility infrastructure commitments that require a substantial capital investment. A budget <br />amendment has been included to recognize the postponement of the Seminola Boulevard Sanitary Sewer <br />Extension Project and to restore Fund Balance to cancel the commitment to utilize reserve funds. <br /> <br />BTR #08-059: <br /> <br />Explanation of Request: Amend the budget to recognize the indefinite deferral of the Seminola Boulevard <br />Sanitary Sewer Extension Project and to restore Fund Balance to cancel the commitment to utilize reserve <br />funds. <br />
