RESOLUTION 08-1957 "A RESOLUTION OF THE CITY OF CASSELBERRY AUTHORIZING THE EXECUTION OF A SITE LEASE COMMUNICATIONS AGREEMENT WITH ROYAL STREET COMMUNICATIONS FOR THE LEASE OF A PORTION OF CITY PROPERTY AT THE SOUTH WATER PLANT WATER TOWER FOR ANTENNA PLACEMENT; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." WHEREAS, the City of Casselberry desires to enter into a Site Lease Communications Agreement subject to the terms and conditions of the Agreement; and WHEREAS, the City will be leasing a portion of the property at the South Water Plant for the placement of communication antennas on the water tower; and WHEREAS, the lease agreement will be for a term of five (5) years with rent of $26,000.00 per year with three (3) additional five (5) year renewal options. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby accepts the lease with Royal Street Communications "attached as Exhibit An and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of any Resolutions in conflict with any of the provisions ofthis Resolution are hereby repealed SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION V. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
