<br />EXHIBIT 'A' <br /> <br />4. CONTRACT TIME AND LIQUIDATED DAMAGES <br /> <br />Work under this Agreement shall be commenced within thirty (30) days after issuance of <br />written Notice to Proceed, and shall be completed within ninety (90) calendar days from <br />commencement of construction date to Substantial Completion from the issuance of the <br />written Notice to Proceed plus fifteen (15) calendar days to Final Completion. Contractor <br />shall pay the Owners as liquidated damages the amount of ONE THOUSAND FIVE <br />HUNDRED DOLLARS & NO/CENTS ($1,500) for each calendar day that expires after the <br />Contract Time specified above including any adjustments thereof approved by proper <br />Change Order until the Work is finally complete. This amount represents an estimate of <br />Owner's damages for loss of use and administrative costs associated with delay. <br /> <br />5. AUTHORITY AND RESPONSIBILITY OF THE OWNER <br /> <br />All Work shall be done under the general supervision of the Owner. The Owner shall <br />decide any and all questions which may arise as to the quality and acceptability of <br />materials furnished, work performed, rate of progress of work, interpretation of <br />Specifications, and all questions as to the acceptable fulfillment of the Agreement on the <br />part of the Contractor. These provisions shall not release the Contractor from any <br />Contractor responsibility contained herein. <br /> <br />6. CONTRACT DOCUMENTS <br /> <br />The Agreement comprises the Contract Document listed herein. In the event that any <br />provision of one Contract Document conflicts with the provisions of another Contract <br />Document, the provision in that Contract Document first listed below shall govern, except <br />as otherwise specifically stated: <br /> <br />a. Agreement (this instrument); <br />b. Change Orders <br />c. Addenda to Contract Documents, Nos. _' _, _; <br />d. Proposal; <br />e. Instructions for Bidders; <br />f. Detailed Specification Requirements; <br />g. Drawings <br />h. General Conditions; <br />i. Advertisement; <br />j. Performance and Payment Bonds; <br />k.
