<br />RESOLUTION 08-1961 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE EXECUTION OF THE AGREEMENT WITH SOUTHERN <br />LANDSCAPING AND IRRIGATION SYSTEMS, INe. FOR THE LANDSCAPING <br />AND IRRIGATION OF THREE FLORIDA DEPARTMENT OF <br />TRANSPORTATION (FDOT) VACANT PARCELS; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry has identified the need to improve the aesthetics of the three <br />(3) vacant FOOT parcels acquired by the FOOT as part of the proposed flyover at the intersection of US 17- <br />92 & SR 436; and <br /> <br />WHEREAS, these areas are within the City's redevelopment corridor and along one of the primary <br />entrances into the City; and <br /> <br />WHEREAS, the City of Casselberry and FOOT entered into a Joint Participation Agreement, <br />whereby FOOT will reimburse the City up to $131,255 for the installation of landscaping and irrigation on <br />the vacant parcels; and <br /> <br />WHEREAS, the Public Works Department requested cost proposals for these proposed <br />improvements; and <br /> <br />WHEREAS, the Public Works Department has reviewed the proposal from Southern Landscaping <br />and Irrigation Systems, Inc. in the amount of $94,586.94, and found it to be the lowest responsive, <br />responsible, and adequate proposal to meet the project requirements of the City. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Agreement <br />with Southern Landscaping and Irrigation Systems, Inc., attached as "Exhibit A", and authorizes the Mayor <br />to execute said document on behalf of the City. <br /> <br />SECTION n. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION m. Severabilitv. Ifany Section or portion ofa Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect <br />of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its <br />passage and adoption. <br />
