RESOLUTION 08-1952 A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, ADOPTING AN IDENTITY THEFT DETECTION AND PREVENTION PROGRAM: PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, effective December 4, 2003 the Fair & Accurate Credit Transactions Act of 2003 (FACT Act) was signed into law (Pub. L. No. 108-159, 117 Stat. 1952) and amends the Fair Credit Reporting Act (FRCA) in an attempt to improve the accuracy of consumer reports and to help prevent identity theft; and WHEREAS, Federal Regulation 63 718 (November 9, 2007) requires each financial institution and creditor to develop and implement a written Identity Theft Detection and Prevention Program to be in place not later than November I, 2008 to help prevent identity theft and report any incidents thereof; and WHEREAS, a utility company is defined as a creditor under the regulations and the City of Casselberry meets the definition of a utility. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission hereby adopts an Identity Theft Detection and Prevention Program (attached as Exhibit A) to verify and protect any individual's personal information against identity theft at all times. SECTION 2. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION 3. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
