All fees associated with this variance request must be paid in full within 30 days of the date of the Board <br />of Adjustment meeting. <br />7. All of the above conditions shall be fully and faithfully executed or the variance shall become null and <br />void. <br /> <br />A discussion ensued regarding the uses and zoning classifications for the adjacent properties. Mr. Senzee said <br /> <br />the Code stipulates that the cell tower separation requirement is from residentially zoned parcels and not from <br /> <br />residentially used parcels. Mr. Senzee said there are three adjacent parcels that are zoned residential. <br /> <br />Mr. Senzee said the conservation easement prohibits any type of development of any buildings; however, St. <br /> <br />John's River Water Management District has begun a program that could waive this requirement. <br /> <br />In response to the Board's question, Mr. Senzee said he received information from City staff that there are <br /> <br />preliminary plans to construct a cell tower that would be located on City-owned property; however, he did not have <br /> <br />specific details. <br /> <br />Mr. Senzee reviewed the map that was included with the variance notification that was mailed to the surrounding <br /> <br />property owners (a copy of the map is on file in the Community Development Department). <br /> <br />Mr. Billerbeck asked the applicant to come forward and provide rebuttal to the City's presentation. Ms. Hoctor <br /> <br />said the proposed cell tower that staff referred to would not cover this area. Ms. Hoctor said the conservation easement <br /> <br />was given as a condition of a permit from the St. John's Water River Water Management District for mitigation. <br /> <br />Mr. Billerbeck asked if there was anyone in the audience who wished to speak in favor of the request. No one <br /> <br />came forward. <br /> <br />Mr. Billerbeck asked the City for rebuttal information. Mr. Senzee said although the conservation easement <br /> <br />prohibits any type of building the Code clearly states that it is residential zoned property and arguing the use isn't part of <br /> <br />the Code. <br /> <br />Mr. Billerbeck asked if there was anyone in the audience who wished to speak in opposition to the request. No <br /> <br />one came forward. <br /> <br />Mr. Billerbeck asked for any general comments. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, <br /> <br />Florida came forward. Mr. Casselberry questioned the type of tower to be constructed and the amount of wattage for the <br />
