<br />Board of Adjustment <br />July 27, 2006 <br />Page 3 <br /> <br />Mr. Billerbeck asked if there was anyone in the audience who wished to speak in opposition to the request. No <br /> <br />one came forward. <br /> <br />Mr. Billerbeck asked the applicant for a closing statement. Mr. Steve Berg said they have spent approximately <br /> <br />$6000 in architect and engineering fees. He said to redesign the addition would require discarding the original drawings <br /> <br />and starting over. <br /> <br />After a brief discussion, Mr. Billerbeck asked for a motion for BA 06-08. Mr. Miller made a motion to approve BA <br /> <br />06-08 with the Board of Adjustment findings which are: <br /> <br />1. Special condition exists due to the pie shape of the lot and is peculiar to the area. <br />2. The conditions were not created by the applicant in that it was preexisting prior to the applicant's purchase <br />of the property. <br />3. Special privileges would not be conferred upon the applicant because of similar properties on Crystal Bowl <br />Circle that do not have as much lead way as Mr. Criswell stated and the City of Casselberry did not <br />challenge that. <br />4. Hardship conditions do exist in that the applicants have spent a significant amount of money in improving <br />their property value and curb appeal. <br />5. This would be the only minimal variance granted to accomplish what they need in the 1.5 foot <br />encroachment. <br />6. It is not injurious to the public welfare. It helps to increase the value and curb appeal of their property. <br /> <br />Mr. McMullen seconded the motion. Mr. Miller amended his motion to include staff's recommendations. John Witanowski and Lisabeth Renee. Variance <br />request to Chapter II, Article VII, Section 2-7.9 "Accessory Structure," and Table 2-5.4 "Size and Di~ <br />Regulations," to grant a 2-foot encroachment into a rear yard building setback, creating an S-foot rear yard <br />building setback in lieu of the required 1G-foot rear yard building setback. Property located at 20 Cobb~ <br />Court, Casselberry, Florida. <br /> <br />Mr. Billerbeck said that the City requested that the Board of Adjustment continue this item to the August 24, <br /> <br />2006 meeting due to an incorrect advertisement. Mr. Billerbeck asked for a motion for BA 06.11. Mr. McMullen made a <br /> <br />motion to continue BA 06-11. Mr. Bowman seconded the motion. <br />
