<br />Board of Adjustment <br />June 22. 2006 <br />Page 4 <br /> <br />Mr. Billerbeck asked the applicant to come forward. Mr. David King said he is trying to protect his property from <br /> <br />any more damage. In response to the Board's question, Mr. King stated that the existing two-car garage is used as a <br /> <br />laundry area, storage of a bass boat and miscellaneous equipment. Mr. King said he has submitted written statements to <br /> <br />Mr. Dorsten from the adjacent neighbors stating they have no objection to the carport. <br /> <br />A discussion ensued regarding possible solutions for the applicant if the variance was denied. The Westside <br /> <br />Small Area Study was discussed briefly. <br /> <br />Mr. King said he used the internet to research the City Code to determine if a free standing structure or carport <br /> <br />required a building permit. He said that the information on the internet was not current and it is updated yearly which <br /> <br />makes it difficult for a citizen to determine what items require a permit. <br /> <br />There was no rebuttal by the City. <br /> <br />In response to the Board's question, Mr. Dorsten stated that there have been no code changes to the accessory <br /> <br />structure portion of the Code within the last 18 months. <br /> <br />A discussion ensued regarding the notification of the Westside Small Area Study. <br /> <br />Mr. Billerbeck asked if there was anyone in the audience who wished to speak in favor of the request. Mr. <br /> <br />Aurilio Zonni, 421 Forest Park, Casselberry, Florida came forward to speak in favor of the request. He said the structure <br /> <br />is very solid and it matches the rest of the building. Mr. Zonni said he is concerned with disabled vehicles in his <br /> <br />neighborhood. <br /> <br />Mr. Billerbeck asked if there was anyone in the audience who wished to speak in opposition to the request. Mr. <br /> <br />Roy Burkett, 7306 Winding Lake Circle, Oviedo, Florida came forward to speak in opposition to the request. Mr. Burkett <br /> <br />said he is representing Mr. Cerni, property owner at 87 and 91 North Griffin Drive, Casselberry, Florida. He said Mr. <br /> <br />Cerni is concerned with the impact on his property and the ability to acquire future renters. He said Mr. Cerni believes it <br /> <br />is an unwanted intrusion extending too far toward the roadway. <br /> <br />There were no general citizen's comments. <br /> <br />Mr. Billerbeck asked the applicant for a closing statement. A discussion ensued regarding the signed affidavit <br /> <br />from the person residing at 91 North Griffin Drive and it was determined that the affidavit was signed by the tenant and <br /> <br />not the property owner. <br />
