<br />Board of Adjustment <br />March 23, 2006 <br />Page 2 <br /> <br />There was no disclosure of ex-parte communications. <br /> <br />Fourth Item of Business: BA 05-17: Juan Lorenzo. Continued. Variance request to Chapter II, Article VII, Section 2-7.7 <br />and Table 2-5.4 "Size and Dimension Regulations," to grant a 9-foot encroachment into a required 20 foot rear yard, <br />creating an 11-foot rear yard for the construction of an addition. The property is located at 609 Brittany Court, <br />Casselberry, Florida. <br /> <br />Mr. Billerbeck asked the applicant to come forward. Mr. Alexis Lorenzo, 609 Brittany Court, Casselberry, Florida came <br /> <br />forward. Mr. Lorenzo stated that an engineer has inspected the footers and provided documentation to the City. Mr. Lorenzo <br /> <br />stated that Mr. Aldrich requested a blueprint for the windows and doors. <br /> <br />Mr. Matt Dorsten, Planner, reviewed the background information and the analysis of the request, provided in his <br /> <br />memorandum to the Board of Adjustment, dated March 17, 2005 (copy on file in the Community Development Department). Mr. <br /> <br />Dorsten stated the information regarding the footer has not altered the Community Development Department's recommendation <br /> <br />of denial as documented in the staff report dated November 9, 2005. He said the variance application does not meet all of the <br /> <br />criteria for granting of a variance; therefore, City staff cannot support the request. <br /> <br />Mr. Dorsten said if the Board of Adjustment chooses to grant the setback variance request for BA 05-17, the property <br /> <br />located at 609 Brittany Court, for a 9-foot encroachment into a required rear yard building setback, creating an 11-foot rear yard <br /> <br />in lieu of the required 20-foot rear yard required; the motion should be based upon the Board of Adjustment's findings of fact and <br /> <br />conclusions, the property site plan (Exhibit B of November 9, 2005 staff report) dated October 8, 2003, and the conditions <br /> <br />outlined in the staff report which were: <br /> <br />1. The variance shall only pertain to the proposed addition. <br />2. A building permit for the addition shall be obtained from the City's Building Safety Bureau within 60 days of the <br />approval by the Board of Adjustment and a final inspection shall be obtained within 180 days of the issuance of <br />the building permit. <br />3. All of the above conditions shall be fully and faithfully executed or the variance shall become null and void. <br /> <br />Mr. Dorsten corrected the staff report stating that the variance request is to the rear yard setback. <br /> <br />Mr. Billerbeck asked the applicant to come forward. Mr. Alexis Lorenzo came forward and said he had nothing further to <br /> <br />add to the meeting. <br /> <br />Mr. Billerbeck asked if there was anyone in the audience who wished to speak in favor of the request. No one came <br /> <br />forward. <br /> <br />Mr. Billerbeck asked if there was anyone in the audience who wished to speak in opposition to the request.
