<br />City Commission Meeting <br />October 22, 2007 <br />Page 9 <br /> <br />B. SPR 07-01 - Amendment to the Legacy Park Conceptual Development Plan <br /> <br />Staff Presentation bv Sandra Smith. Chief Planner: SPR 07-01 is an amendment to <br />the Legacy Park Conceptual Development Plan. This is a review of the plans and <br />supporting information provided to the City by Jon Walls of Miller Legg on behalf of <br />Northland Church and Geneva School for the amendment to the conceptual plan for the <br />Legacy Park Planned Development. The applicant is requesting the plan be amended to <br />allow a school in lieu of the church and to allow condominium units. A similar request <br />for condominiums to utilize the same design criteria as apartments was considered by the <br />Commission under Ordinance 07-1228 (LPA 07-01). The City can provide the needed <br />utilities to the site and the interior roadways can accommodate the traffic. The traffic <br />study indicates a fair share cost by the Geneva School developer for each intersection <br />should they become signalized and potential design modifications to the intersections. A <br />Site Plan Agreement will be considered by the Commission later on the Agenda under <br />Resolution 07-18835 that addresses both conditions of approval placed on this <br />amendment to the Conceptual Plan for Legacy Park as well as the Conditional Use and <br />Conceptual Plan for the Geneva School. The Planning and Zoning Commission <br />approved the conceptual plan at the meeting of August 22, 2007 with the following <br />conditions (Exhibit D) that will be incorporated into the Site Plan Agreement: <br /> <br />I) Approval of the school use is specifically for the primary educational functions <br />attributed to an educational facility or institution and the proposed ancillary uses, <br />including ball fields, courts, and a stadium. Review of this development plan is <br />conceptual only and all details for final permitting shall be submitted for review <br />and final approvals. <br /> <br />2) The condominium use in Tract 8 will adhere to the design requirements provided <br />for apartments in Unified Land Development Regulations, Section 2-7.26. <br />3) The connection of the pedestrian walkway around the retention area and the <br />internal roadway between the residential community and the school site shall be <br />completed in conjunction with the first phase of construction of the school or the <br />development of adjacent Tracts 8,0-1 or 0-2; whichever site develops first. <br /> <br />4) As a participant in the Master Association for the Legacy Park Planned <br />Development, Geneva School and its assigns agree to, and are responsible for, <br />their pro-rata costs of the construction of the Village Center Plaza, as indicated on <br />the site plan. The City must provide site plan review and approval of the plaza <br />prior to construction. <br /> <br />5) The amended conceptual plan shall be further revisied to incorporate the <br />conclusions of the L TEC traf1ic study dated March 29, 2007 and/or the <br />requirements of the Seminole County Traffic Engineering Department. <br />
