Except for the purpose of inquiries and investigations <br />under Section (see below) the Commission or its members shall deal with city officers and <br />employees who are subject to the direction and supervision of the city manager solely through <br />the city manager, and neither the Commission nor its members shall give orders to any such <br />officer or employee, either publicly or privately. The Commission and city manager agree to <br />mutually respect and abide by their respective roles and duties. Nothing in this section shall <br />be interpreted to mean that Commission members cannot speak to any officer or city employee <br />at a reasonable time and place for reasonable purposes. <br /> <br />Ms. Crotty stated the investigations power currently exists in Section 13 (4) of the City Charter. The <br />following new section was suggested in the Committee's final report: <br /> <br />Add a new section entitled Investigations <br />The city commission may make investigations into the affairs of the city and the conduct of any <br />city department, office, or agency. <br /> <br />Commissioner Miller inquired what would be the process to initiate an investigation. Committee Member <br />Dennison clarified that it would require a majority of the Commission to initiate an investigation. <br /> <br />Ms. Crotty stated the following additional language was suggested to assure the Commission will act in a <br />timely fashion to fill vacancies: <br /> <br />Section 14. Vacancy in the Office of City Commission Members <br />If the Commission fails to do so within thirty days following the occurrence of the vacancy, the <br />city clerk shall call a special election to fill the vacancy, to be held not sooner than ninety days <br />and not later than 120 days following the occurrence ofthe vacancy, and to be otherwise <br />governed by law. <br /> <br />Article V. City Manager <br /> <br />Ms. Crotty stated the current City Charter includes most of the language that is in the Model Charter, <br />however, the Model expands the duties to include #10,11,12 and 13 below as more contemporary <br />practices across the country. The Charter Review Committee recommended that this language replace the <br />current section: <br /> <br />Sec. 26. Powers and Duties <br />The City Manager shall be the chief executive officer of the City, responsible to the Commission for <br />the management of all City affairs placed in the Manager's charge by or under this charter.
