Powers of the Municioality <br /> <br />Ms. Crotty stated the intent of the proposed changes is to grant the City all powers it is legally authorized <br />to exercise. The following revisions to Article III were recommended in the Committee's final report: <br /> <br />Section 7. General Powers will be reworded as follows: <br />The city shall have all powers possible for a city to have under the constitution and laws of this <br />state as fully and completely as though they were specifically enumerated in this charter. <br /> <br />Section 8. Specific Powers - delete this section; change the title of the section to Construction <br />and insert the following: <br />The powers ofthe city under this charter shall be construed liberally in favor of the city and the <br />specific mention of particular powers in the charter shall not be construed as limiting in any way <br />the general power granted in this article. <br /> <br />Add new section entitled Intergovernmental Relations <br />The city may participate by contract or otherwise with any governmental entity of this state or any <br />other state or states or the United States in the performance of any activity which one or more of <br />such entities has the authority to undertake. <br /> <br />Committee Member Dennison commented that the Charter Review Advisory Committee had a lot of <br />discussion and felt this recommended streamlining of powers would allow the Commission to set policy <br />through ordinances. <br /> <br />Article IV. Form of Governmenl: City Commission <br /> <br />Ms. Crotty stated the changes recommended in Section 12 include deletion of service of process, the <br />addition of "shall have no administrative duties", changing the title of Vice Mayor to Deputy Mayor, and <br />the election of the Deputy Mayor in election and non-election years. The following revisions to Section 12 <br />were recommended in the Committee's final report: <br /> <br />Section 12. Mayor; Deputy Mayor <br />The Mayor shall preside at all meetings of the City Commission, shall be recognized as head of the <br />city government for all ceremonial purposes, by the governor for purposes of military laws, for <br />execution of contracts, deeds, and other documents, but shall have no administrative duties. The <br />Mayor shall be a member of the City Commission and shall have a vote as a Commissioner on any <br />matters coming before the City Commission. <br /> <br />The City Commission shall, in a municipal election year, elect from among its members a Deputy <br />Mayor at the first meeting after all of the newly elected Commissioners are seated. In non-election <br />years, the City Commission shall elect a Deputy Mayor from among its members at the first <br />regular Commission meeting in November. <br /> <br />Mayor Goff was stated he was in favor of the deletion of the service of process. <br />
