<br />D. The ENGINEER represents that all personnel engaged in the work shall be <br />fully qualified. <br /> <br />E. The ENGINEER shall promptly begin work on the services authorized by this <br />Supplement upon execution of this Supplement and will complete the <br />specified services within the dates established by the City for this project. <br />The project must be completed within 120 days to qualify for the <br />USDNNRCS funding. This assumes normal reviews by the City and <br />intervention of the City with SJRWMD for emergency relief in order to <br />expedite or issue an exemption of the permitting process. <br /> <br />SECTION 4 <br />SUPPLEMENTARY SERVICES OF THE ENGINEER <br /> <br />A. If authorized by the OWNER, the ENGINEER shall furnish or obtain from <br />others, supplementary services of the following types which will be paid for <br />by the OWNER as an additional cost as outlined in Section 6. <br /> <br />B. Additional services due to significant changes in the scope of the project <br />including, but not limited to, changes in size, complexity, character, or due to <br />time delays in initiating or completion of the work as described herein. <br /> <br />C. Provide specialty services through subconsultants. If these services are <br />subsequently determined advisable during the course of the work, they may <br />be considered for authorization as an additional service under this Section of <br />the Supplement or separately provided by the OWNER. <br /> <br />D. Except as otherwise provided herein, services or additional costs associated <br />with revising previously accepted studies, reports, or other documents <br />prepared by the ENGINEER when such revisions are due to causes beyond <br />the ENGINEER's control. <br /> <br />E. Additional services resulting from public protests, administrative hearings, or <br />similar matters. <br /> <br />F. Preparing to serve and/or serving as an Expert Witness for the OWNER in <br />any litigation, public hearing, condemnation proceeding, right-of-way or <br />easement acquisition or negotiation, or other legal/administrative proceeding. <br /> <br />G. Additional engineering services required by revisions to regulations (after the <br />date for this Supplement) as applicable to the U.S. EPA, Florida Department <br />of Envirollmental Protectioll, U.S. Department of Labor, OSHA, or other <br /> <br />3 <br />
