Mr. <br /> <br />McMullen addressed criteria no 5 stating that "The variance is not necessary to make possible reasonable use of the land <br /> <br />and if the variance is not approved the 36 20' poles would result in the loss of over 100 parking spaces which would <br /> <br />create a hardship on the applicant." Ms. Gauvin seconded the motion. (Refer to the April 24, 2008 minutes that clarified <br /> <br />the adoption of this motion.) <br /> <br />Mr. Bowman clarified the motion to approve the variances of BA 08-03 with the conditions for lighting plan <br /> <br />number 1 modified to read that the poles are 32 ~ foot poles (12 -% feet more than permitted) including the conditions of <br /> <br />approval outlined in the staff report, the Board would like the light pole furthest from State Road 436 be moved into the <br /> <br />landscape islands and a fourth light added to that pole to give proper illumination and a landscape island be added to the <br /> <br />three existing lights located in the parking lot. <br /> <br />The Board was polled. <br /> <br />Mary Anne Gauvin Yes <br />Earl McMullen Yes <br />Ed Bowman Yes <br />Luis Guzman No <br />Arlin Armour Yes <br /> <br />The motion passed with a majority vote. <br /> <br />Fifth Item of Business: Other Business <br /> <br />There being no further business to come before the Board, motion was made, seconded and passed to adjourn. <br /> <br />Tapes of the meeting are available as a matter of public record. <br /> <br /> <br />
