<br />Board of Adjustment <br />June 26, 2008 <br /> <br />Page 3 <br /> <br />Ms. Miller felt that it was unfair for the Board to consider possible future variance requests that would affect the Board's <br /> <br />judgment on this variance request. In response to the applicant's question, Mr. Senzee said that the applicant could modify their <br /> <br />variance request. He said that the applicant is requesting approximately 866 sq. ft. of pool and deck area and if the 5' setback <br /> <br />variance was eliminated the applicant could add a 666 sq. ft size pool and deck. He said this would eliminate the variance for the <br /> <br />impervious surface area. <br /> <br />Mr. Miller said they would like to have a nice size pool to use for their enjoyment. Mr. Miller felt the addition of the pool <br /> <br />would be a benefit to the neighborhood. <br /> <br />A discussion ensued regarding the proposed size of the pool, the lot sizes for the various properties that have constructed <br /> <br />pools in the Lake Griffin Estates subdivision and the distance required from the pool to the house. <br /> <br />Mr. Armour read a portion of the Architectural Review Committee letter which stated: "That plan has been reviewed for the <br /> <br />limited purpose of determining aesthetic compatibility of the plans with the community in general in the subjective opinion of the <br /> <br />approving authority. No review has been made with respect to functionality, safety, compliance with governmental regulations, or <br /> <br />otherwise, and no reliance on this approval should be made by any party with respect to such matters." Mr. Armour said the letter <br /> <br />is an aesthetic approval from the Architectural Review Board. A general discussion ensued regarding approval from the <br /> <br />Homeowners' Association. <br /> <br />Ms. Gauvin asked if there was anyone in the audience who wished to speak in favor of the request. No one came <br /> <br />forward. <br /> <br />There was no rebuttal by the City <br /> <br />Ms. Gauvin asked if there was anyone in the audience who wished to speak in opposition to the request. No one came <br /> <br />forward. No one came forward. <br /> <br />There were no general comments from audience. <br /> <br />After a brief discussion, Ms. Gauvin asked for a motion for BA 08-06. Mr. Guzman made a motion to deny BA 08-06.
