RESOLUTION 08-1930 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, FOR THE EXECUTION OF THE JOINT PARTICIPATION AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, one of the main corridors into the City of Casselberry is US 17-92; and WHEREAS, the City desires to continually enhance and improve the major corridors into the City; and WHEREAS, Florida Department of Transportation agreed to compensate the City in the amount of$13l,255 for providing temporary landscaping and irrigation improvements on three (3) vacant FDOT properties on US Highway 17-92 between Pine Street and Piney Ridge Road; and WHEREAS, it would be beneficial for the City to receive funding from FDOT to enhance the appearance of the vacant properties on US Highway 17-92; and WHEREAS, the Public Works Department has reviewed the proposed Joint Participation Agreement between the City of Casselberry and the Florida Department of Transportation and find it complete and favorable to the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Joint Participation Agreement between the Florida Department of Transportation and the City of Casselberry; Financial Management Number 424374-1-58-01, (attached as Attachment "A"), and authorizes the Mayor to execute said document on behalf of the City. SECTION II. The City Commission hereby accepts the terms and conditions as presented in said Agreement. SECTION III. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION IV. Severabilitv. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION V. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
