<br />this MOU based on its home rule powers, and the CITY finds that this MOU is consistent with <br />its Comprehensive Plan, and in the best interests of the citizens, <br /> <br />5) This MOU may not be assigned by any of the parties. <br /> <br />6) This MOU is not intended to, nor will it prevent or impede the CITY, from exercising its <br />legislative authority as the same may affect the PROJECT. <br /> <br />7) This MOU will terminate 90 calendar days from the date of execution by the last party to <br />execute this MOU, unless extended by mutual agreement of the CITY and the DEVELOPER. <br /> <br />8) It is the intention of the parties that the language used in the MOU is not necessarily to be <br />incorporated verbatim into the AGREEMENT, and that terms and provisions not set forth <br />herein will be added as mutually agreed upon by the parties and as the respective counsel <br />deem appropriate. Many of the terms and conditions of the AGREEMENT have been <br />previously set forth in the Request for Qualification for development of the PROJECT, and <br />that Request for Qualification shall become part of the AGREEMENT. <br /> <br />9) Notices.
