<br />RESOLUTION 08-1874 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF <br />CASSELBERRY, THE CASSELBERRY COMMUNITY REDEVELOPMENT AGENCY <br />(CRA) AND CENTURY RETAIL GROUP ON THE CITY CENTER DEVELOPMENT, <br />PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE" <br /> <br />WHEREAS, the development of the City Center site in the best interest of the City, the <br />Casselberry Community Redevelopment Agency, and the Century Retail Group; and <br /> <br />WHEREAS, the City of Casselberry the Casselberry Community Redevelopment Agency <br />and the Century Retail Group need to define the basic parameters for the enactment of a <br />Development and Disposition Agreement on the 15 acre City Center site; and <br /> <br />WHEREAS, A Memorandum of Understanding is the initial step in the creation of a <br />"Development and Disposition" Agreement; and <br /> <br />WHEREAS, City staff and the City Attorney have reviewed the Memorandum of <br />Understanding between the City, the CRA and Century Retail and finds the requirement to be in <br />the interest of the City and favorable for the development of a long term "Development and <br />Disposition" Agreement. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Memorandum of Understanding for the development of said property and authorizes the Mayor to <br />execute said document on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
