<br />RESOLUTION 08-1903 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF THE AGREEMENT WITH AMERICAN PERSIAN ENGINEERS & <br />CONSTRUCTORS, INC. (APEC) FOR THE PLUMOSA AVENUE AND U.S. 17-92 <br />INTERSECTION IMPROVEMENTS PROJECT; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry has identified the intersection of Plumosa Avenue and U.S. 17-92 as <br />requiring a modification to become a fully functioning intersection with a required traffic signal; and <br /> <br />WHEREAS, the City of Casselberry advertised for bids in the Orlando Sentinel on May 25 and June 1,2008 <br />for the Plumosa Avenue & U.S. 17-92 Intersection Improvements Project; and <br /> <br />WHEREAS, on June 25, 2008, the City received seven (7) sealed bids; and <br /> <br />WHEREAS, APEC, Inc. has submitted the lowest bid in the amount of $1,429,501.20, and has performed <br />similar work for the City; and <br /> <br />WHEREAS, City staff has reviewed the bid proposal from APEC, Inc., in the amount of $1,429,501.00, and <br />found it to be the lowest responsive, responsible, and adequate bid proposal to meet the project requirements of the <br />City; and <br /> <br />WHEREAS, a 10% contingency in the amount of $142,950.12 has been allocated for the project, bringing <br />the total amount required to $1,572,541.30; and <br /> <br />WHEREAS, in 2007 the Casselberry Redevelopment Agency approved funding in the amount of $225,000 <br />toward this project; and <br /> <br />WHEREAS, the balance of the construction cost is available through the Capital Improvement Fund _ Local <br />Option Gas Tax ($1,347,451.30). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Agreement with APEC, <br />Inc., attached as "Exhibit A", and authorizes the Mayor to execute said document on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any ofthe provisions of this <br />Resolution are hereby repealed. <br /> <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, <br />unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other <br />Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and <br />adoption. <br />
