<br />2-7.29 Check Cashing/Payday Loan Businesses. <br /> <br />(1) Check cashing/payday loan businesses shall be permitted in General <br />Commercial Zoning Districts (CG), except that no check cashing/payday loan <br />business or its agents or facilitators shall be located within two (2) miles of any other <br />check cashing/payday loan business or within 2,500 feet of any residential zoning <br />district, any retirement or assisted living facility for senior citizens, any day-labor <br />employer or temporary employment agency, any traditional bank, credit union or <br />trust company, any pawn shop, or any retail business that provides check cashing <br />or loan services as an incidental part of its business. <br /> <br />(2) This distance shall be measured, without regard to municipal <br />boundaries, following the shortest route of ordinary pedestrian travel from the main <br />entry of the check cashing/payday loan's establishment, continuing along the <br />pedestrian walkway provided on the check cashing/payday loan's property to a <br />public thoroughfare, and then continuing along the public thoroughfare to the <br />nearest property line of the business or district set forth in Section 2-7.29 (1). <br /> <br />(3) Variances to the distance requirements may be requested through an <br />application submitted to the City Commission utilizing the procedures and criteria <br />provided in ULDR Section 1-2.7. <br /> <br />(4) Check cashing/payday loan businesses lawfully operating on August <br />11, 2008, shall be deemed legally nonconforming uses governed by Chapter II, <br />Article VIII of the Unified Land Development Regulations. <br /> <br />SECTION 3. That Section 5-21.2 of Article XXI, Chapter V, Glossary, Part III, <br /> <br />Unified Land Development Regulations, of the Code of Ordinances of the City of <br /> <br />Casselberry, Florida shall be amended to include the definition of "Check Cashing/Payday <br /> <br />Loan Business" as follows: <br /> <br />Check CashingIPayday Loan Business means an entity that is <br />engaged in the business of providing currency for payment <br />instruments for a fee, including, but not limited to, deferred <br />presentment providers, as defined by Florida Statutes. Check <br />Cashing/Payday Loan Businesses may also provide other <br />services to their customers, including, but not limited to, tax <br />preparation and postal services.
