<br />ORDINANCE 08-1247 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; <br />AMENDING THE CITY OF CASSELBERRY, FLORIDA CODE OF <br />ORDINANCES, PART III, UNIFIED LAND DEVELOPMENT <br />REGULATIONS, AS FOLLOWS: AMENDING SECTION 2-5.3, <br />LAND USE BY DISTRICTS, TABLE 2-5.3 LAND USE BY <br />DISTRICTS (1), ARTICLE V, ZONING DISTRICT REGULATION, <br />CHAPTER II, DISTRICT AND GENERAL REGULATIONS, TO <br />INCORPORATE REFERENCE TO CHECK CASHING/PAYDAY <br />LOAN BUSINESSES AND CORRESPONDING FOOTNOTE; <br />CREATING A NEW SUBSECTION 2-7.29, ARTICLE VII, GENERAL <br />REGULATIONS, CHAPTER II, DISTRICT AND GENERAL <br />REGULATIONS, TO REGULATE THE LOCATION OF CHECK <br />CASHING/PAYDAY LOAN BUSINESSES; AMENDING SECTION 5- <br />21.2, DEFINITION OF TERMS, OF ARTICLE XXI LANGUAGE AND <br />DEFINITIONS, CHAPTER V, GLOSSARY, TO INCLUDE THE <br />DEFINITION FOR "CHECK CASHING/PAYDAY LOAN BUSINESS"; <br />PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS, <br />AND EFFECTIVE DATE. <br /> <br />WHEREAS, check cashing/payday loan businesses provide currency for payment <br />instruments of low and financially challenged persons, including senior citizens, for a fee; <br />and <br /> <br />WHEREAS, there are nine check cashing/payday loan businesses currently <br />operating in the City of Casselberry, which attract many customers from areas outside the <br />City; and <br /> <br />WHEREAS, the City Commission of the City of Casselberry has determined that <br />check cashing/payday loan businesses may be detrimental to the general welfare, and may <br />reduce and impair property values, because these businesses can have an adverse effect <br />upon the economically challenged, are open long hours, generate additional noise and <br />traffic coming from outside the City; and <br /> <br />WHEREAS, the City Commission of the City of Casselberry has determined that it is <br />appropriate and in the public interest to regulate check cashing/payday loan businesses to <br />limit their numbers in the City, and to place distance restrictions between these businesses <br />and other businesses and financial institutions, since the businesses can be problematic <br />uses. <br /> <br />Ordinance 08-1247 <br />Page 1 of 4 <br />
