<br />RESOLUTION 08-1898 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />APPROVAL OF A CONSUMER PRICE INDEX (CPI) RATE ADJUSTMENT FOR 2008 <br />FOR RESIDENTIAL SOLID WASTE AND RECYCLING COLLECTION SERVICES <br />PROVIDED BY REPUBLIC SERVICES, INC; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry entered into a contract dated December 27, 2001 with Republic <br />Services, Inc. for residential solid waste and recyclable collection; and <br /> <br />WHEREAS, Exhibit 2 of said contract allows for annual rate adjustments after the first 12 months <br />based on the previous year's CPI; and <br /> <br />WHEREAS, RepubliC Services, Inc. has provided the City with the calculations of percent <br />increases from December 2006 to December 2007 (5.29%) based on a report from the U.S. Department of <br />Labor, Bureau of Labor and Statistics; and <br /> <br />WHEREAS, the City's current contract with Republic Services, Inc. will expire on December 31, <br />2008 and it is anticipated that a monthly increase of at least $4 to $6 per residential customer will occur <br />once contract negotiations with Republic Services, Inc., or an alternative bid process, are complete; and <br /> <br />WHEREAS, in order to apply the increase gradually, staff is recommending that the CPI <br />adjustment for 2008, in the annual amount of $41,854.44 ($0.47 x 7,421 customers x 12 months = <br />$41,854.44) be passed on to each customer over the months of September through December, 2008; and <br /> <br />WHEREAS, the new rate per customer will equate to $16.35/month for regular curbside service <br />(and for side door services for residents with debilitating conditions) and $22.69 for side door services with <br />no debilitating condition-effective September 1, 2008; and <br /> <br />WHEREAS, a separate increase in the collection charge for additional trash and vegetative waste <br />will be increased from $7.44/cubic yard to $7.83/cubic yard; and <br /> <br />WHEREAS, City staff has reviewed the proposed residential solid waste consumer price index <br />adjustment and recommends its approval. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the request from <br />RepubliC Services, Inc. to adjust the residential solid waste rates in accordance with the 2007 consumer <br />price index and to pass the increase (in the amount of approximately $41,854.44) on to City residential <br />solid waste customers. . <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions <br />of this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of <br />any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage <br />and adoption. <br />
