Amendment to Section 9 of the Agreement. Section 9 <br /> <br />"Reporting Requirements" is hereby amended to read as follows: <br /> <br />SECTION 9. <br /> <br />REPORTING REQUIREMENTS. <br /> <br />CITY shall fully complete and <br /> <br />provide to the CS Administrator a monthly report in the form of Exhibit D <br /> <br />(attached hereto and incorporated herein) summarizing the number of <br /> <br />active Project components under construction, all bid information, and <br /> <br />construction summaries. CITY shall provide the monthly reports no later <br /> <br />than the fifteenth (15th) day of each month. Failure by CITY to submit a <br /> <br />monthly report shall allow COUNTY to withhold reimbursement payment on <br /> <br />the Request for Payment submitted by CITY until the required monthly <br /> <br />report is submitted as mandated herein. <br /> <br />CITY shall provide an end of <br /> <br />Project financial reporting and reconciliation statement upon completion <br /> <br />of the Project and in no event later than January 31, ~ 2010. COUNTY <br /> <br />shall not be obligated to payor reimburse any Project costs incurred by <br /> <br />CITY after December 31, ~ 2009. <br /> <br />COUNTY shall have access to and be <br /> <br />provided copies and transcripts of any records necessary to accomplish <br /> <br />this obligation in the sole determination of COUNTY or HUD. <br /> <br />Section 8. Effect of First Amendment on Agreement. The remaining <br /> <br />portions of the Agreement as well as the Exhibits/Attachments thereto <br /> <br />not expressly amended by this instrument shall remain in full force <br /> <br />and effect as originally agreed upon. The severability clause in <br /> <br />Section 28 of the Agreement shall be deemed applicable to this First <br /> <br />First Amendment HUD CDBG Agreement with City of Casselberry 2007-2008 <br />Page 6 of 10 <br />
