<br />Exhibit "A" <br /> <br />PROJECT NO. 0805 <br /> <br />SECTION 00500 <br /> <br />AGREEMENT <br /> <br />1. THIS AGREEMENT, made as of the day of Auqust. 2008, by and between <br />the City of Casselberry, Florida, hereinafter called the Owner and Eden Site Development <br />hereinafter called the Contractor, <br /> <br />WITNESSETH, that the Owner and the Contractor, for the considerations stated herein, <br />agree as follows: <br /> <br />2. SCOPE OF WORK <br /> <br />The Contractor shall provide and furnish all of the necessary labor, supervision, material, <br />tools, expendable and permanent equipment, and all utility and transportation services <br />required to perform and complete in a workmanlike manner, all of the work described as: <br />"Wet Weather Storage Pond Slope Liner Replacement" for the City of Casselberry, <br />Florida. <br /> <br />All work shall be performed in strict accordance with the Drawings & Specifications <br />prepared by CPH Engineers, Inc., hereinafter called the Engineer, and in strict compliance <br />with the Contractor's Proposal as accepted, including any amendments agreed upon at <br />the time of execution of this Agreement, and with the other Contract Documents herein <br />mentioned which are a part of this Agreement. <br /> <br />3. THE CONTRACT PRICE <br /> <br />The Owner shall pay to the Contractor, and the Contractor shall accept, in full payment for <br />the performance of this Agreement, subject to any additions or deductions provided for <br />hereby, based upon the Lump Sum price provided in the proposal attached hereto, in <br />current funds, the Total Aggregate Amount shall not exceed the sum of: ONE HUNDRED <br />NINETEEN THOUSAND FIVE HUNDRED DOLLARS and NO CENTS ($119,500.001 as <br />a lump sum price contract. <br /> <br />Payments are to be made to the Contractor in accordance with and subject to the <br />provisions embodied in the other documents, which are a part of this Agreement. <br /> <br />4. CONTRACT TIME AND LIQUIDATED DAMAGES <br /> <br />Work under this Agreement shall be commenced within thirty (30) days after issuance of <br />written Notice to Proceed, and shall be completed within sixty (60) calendar days to <br />Substantial Completion from the issuance of the written Notice to Proceed plus ten (10) <br />calendar days after date of Substantial Completion. Contractor shall pay the Owners as <br />liquidated damages the amount of ONE THOUSAND DOLLARS & NO/100 ($1,000) for <br />each calendar day that expires after the Contract Time specified above including any <br /> <br />00100 -1 <br />City of Casselberry <br />
