<br />RESOLUTION 08-1910 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF UTILITY EASEMENT(S) BETWEEN THE CITY OF CASSELBERRY AND <br />CASSELBERRY INVESTMENT PROPERTIES, LID., DOROTHY R SMITH, VINCENT DEFILlPPO <br />(CONTEMPORY ASSETS, INc.), MICHELE PASTERNACK, MARIO and KARON ZACCO,AND JOHN <br />A. ZACCO (pROPETY OWNERS ALONG A SECTION OF SEMINOLA BOULEVARD); <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the Seminola Boulevard Sanitary Sewer Project has reached final engineering, design phase and <br />permitting; and <br /> <br />WHEREAS, the Public Works Department has obtained six (6) of the 58 easements required for the project, <br />which are identified by tax parcel ill numbers (09-21-30-527-0000-0010, 09-21-30-5BM-OAOO-0080, 09-21-30- <br />5BM-OAOO-0090, 09-21-30-5BM-OAOO-OIOO, 09-2 1-30-5BM-OAOO-0 I 10, and 09-21-30-5BM-OAOO-0120); and <br /> <br />WHEREAS, in order to construct the first segment of the originally designed infrastructure improvement the <br />City finds it necessary to execute these easements; and <br /> <br />WHEREAS, City staff have reviewed the six (6) separate Utility Easements presented herein and find each <br />Easement favorable to the City. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Utility Easements <br />between the City of Casselberry and (I) Casselbeny Investment Properties, Ltd., (2) Dorothy H. Smi1h, (3) Vincent Defilippo <br />(Contempory Assets, Inc.), (4) Michele Pasternack, (5) Mario and Karon Zacco, and (6).1000 A. Zacco on six (6) separate <br />parcels, (attached as Exhibit "A" through Exhibit "F"), and authorizes the Mayor to execute said document(s) on <br />behalf ofthe City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this <br />Resolution are hereby repealed. <br /> <br />SECTION m. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, <br />unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other <br />Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
