RESOLUTION 08-1919 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, CONFIRMING THE TENTATIVE ACCEPTANCE OF AN URBAN AND COMMUNITY FORESTRY GRANT AND THE INTENT TO ENTER INTO A MEMORANDUM OF AGREEMENT WITH THE STATE OF FLORIDA, DEPARTMENT OF AGRICULTURE AND CONSUMER SERVICES, IF THE GRANT IS AWARDED; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. " WHEREAS, the City of Casselberry submitted an application to the State of Florida, Department of Agriculture and Consumer Services, for a 2008 Urban and Community Forestry Grant in the amount of $5,000; and WHEREAS, the City of Casselberry, through adopted landscaping and tree protection ordinances, site plan reviews and redevelopment, the daily operations of the Public Works Department and Parks & Recreation Division, and the dispersal of arbor information to the general public, takes a very proactive role in the establishment and maintenance of trees located within the City; and WHEREAS, the City has recently received the "Tree City USA" designation; and WHEREAS, the City has launched a project to restore native habitat for local lakes to improve lake quality and erosion protection at the shoreline; and and WHEREAS, the City of Casselberry wishes to replant and reforest with native tree species; WHEREAS, if awarded the grant, the City of Casselberry will enter into a Memorandum of Agreement with the Florida Department of Agriculture and Consumer Services. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry supports the tree planting project as outlined in the grant, agrees that the City will enter into a Memorandum of Agreement with the Florida Department of Agriculture and Consumer Services, and authorizes the Mayor to execute the final Memorandum of Agreement, if received, on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
