<br />RESOLUTION 08-1919 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, CONFIRMING <br />THE TENTATIVE ACCEPTANCE OF AN URBAN AND COMMUNITY FORESTRY <br />GRANT AND THE INTENT TO ENTER INTO A MEMORANDUM OF <br />AGREEMENT WITH THE STATE OF FLORIDA, DEPARTMENT OF <br />AGRICULTURE AND CONSUMER SERVICES, IF THE GRANT IS AWARDED; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. " <br /> <br />WHEREAS, the City of Casselberry submitted an application to the State of Florida, Department of <br />Agriculture and Consumer Services, for a 2008 Urban and Community Forestry Grant in the amount <br />of $5,000; and <br /> <br />WHEREAS, the City of Casselberry, through adopted landscaping and tree protection <br />ordinances, site plan reviews and redevelopment, the daily operations of the Public Works <br />Department and Parks & Recreation Division, and the dispersal of arbor information to the general <br />public, takes a very proactive role in the establishment and maintenance of trees located within the <br />City; and <br /> <br />WHEREAS, the City has recently received the "Tree City USA" designation; and <br /> <br />WHEREAS, the City has launched a project to restore native habitat for local lakes to <br />improve lake quality and erosion protection at the shoreline; and <br /> <br />and <br /> <br />WHEREAS, the City of Casselberry wishes to replant and reforest with native tree species; <br /> <br />WHEREAS, if awarded the grant, the City of Casselberry will enter into a Memorandum of <br />Agreement with the Florida Department of Agriculture and Consumer Services. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry supports the tree planting <br />project as outlined in the grant, agrees that the City will enter into a Memorandum of Agreement <br />with the Florida Department of Agriculture and Consumer Services, and authorizes the Mayor to <br />execute the final Memorandum of Agreement, if received, on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to <br />be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or <br />effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its <br />passage and adoption. <br />
