<br />CASSELBERRY CITY COMMISSION <br />Minutes of June 23, 2008 - Regular Meeting <br />Page 10 of 17 <br /> <br />The City of Casselberry is the applicant for the Transportation Concurrency Exception Area (TCEA). This <br />area is the same as the Community Redevelopment District that is located along U.S. Highway 17-92 and <br />a portion of State Road 436. Once the Department of Community Affairs approves the TCEA, the <br />boundaries ofthe overlay district need to be applied to the Future Land Use Map. The TCEA Study findings <br />were based on higher development intensities (Floor Area Ratio) and densities (Dwelling Units per Acre) <br />within the TCEA. The properties owned by the City within the Concord Center and the City Center sites are <br />targeted for this more compact development classification. Due to the proximity to the Concord Center <br />property, an additional parcel owned by B&B Investments of Central Florida, which Black's Automotive is <br />currently located on, has been included for the FLUM amendment. Ms. Jane Burgett, property owner, has <br />provided a statement to the City agreeing to the proposed change to the property. The Concord Center site <br />parcels designation will change from "Commercial" to "Major Thoroughfare Mixed-Use" and the City <br />Center site parcels designation will change from "High Intensity Non-ResidentiallMedium Density <br />Residential" to "Major Thoroughfare Mixed Use". Justification for the proposed changes were provided in <br />the TCEA Study which was approved by passage of Resolution 08-1890. <br /> <br />The Planning & Zoning Commission, acting as the Local Planning Agency (LP A), reviewed and unanimously <br />approved LP A 08-07 and LP A 08-08 at their May 28, 2008 meeting. Ms. Burgett attended the May 28, 2008 <br />meeting and did not object to the proposed change. <br /> <br />Budget Impact: This item has no budget impact. <br /> <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 08-1241 on first reading. <br /> <br />Public Hearing: The following individual came forward and addressed Ordinance 08-1241: <br /> <br />I) Mr. John Casselberry, 700 South Lost Lake Lane, spoke in opposition to Ordinance 08- <br />1241, because he felt that the Concord Center was too small for mixed use, and it may also <br />complicate the marketing of both the Concord Center and City Center properties. <br /> <br />No one else came forward. Mayor Goff closed the public hearing relative to Ordinance 08-1241. <br /> <br />MOTION: <br /> <br />Commissioner Solomon moved to approve Ordinance <br />08-1241 on first reading as presented. Motion was <br />seconded by Commissioner Miner. Motion carried 4 _ <br />1 (Commissioner Doerner dissenting) by voice vote. <br /> <br />D. Variance Request BA 08-05 - Casselberrv Square (Rice & Beans Club) <br /> <br />Notice of Public Hearing: Notice of Public Hearing was published in the Orlando Sentinel on June 12, <br />2008. Property owners within 500 feet of the location were notified by mail, and the property was posted. <br /> <br />Staff Presentation: Mr. Gerald Paradise, Community Development Director, stated City Code Section 10-7 <br />requires a 1,000 foot distance separation between the businesses selling alcoholic beverages.
