Smith, AICP, Chief Planner <br /> <br />DATE: <br /> <br />May 7, 2008 <br /> <br />RE: <br /> <br />CRA By-Law amendment <br /> <br />The City Manager's office has requested a position be provided on the Community Redevelopment Agency <br />for an ex-officio, non-voting representative for the Seminole County US 17-92 CRA Program Manager. <br />Addition of this position to the CRA would enable better communication and information sharing between <br />Seminole County and the City regarding redevelopment initiatives. <br /> <br />While reviewing the membership section of the By-Laws, the eligibility requirements were found to be in <br />conflict with FS Chapter 163.356 (3)(b) (Exhibit A). The By-Laws currently allow someone who owns <br />residential property to be a member of the CRA. The Statute requires the property owner to either reside at <br />the property or operate a business from the property. FS Chapter 163.356(4) also provides additional <br />reasons for removal from office not currently included in the By-Laws. <br /> <br />The CRA Bylaws may be repealed or amended, or new bylaws may be adopted by a majority vote of the <br />CRA, provided that no such change may occur at the same meeting during which it is proposed without an <br />extraordinary (majority plus one) vote of the CRA. <br /> <br />The proposed changes to the by-laws are as indicated by the double underlined text. <br /> <br />Article III. Membership <br />A. The Community Redevelopment Agency shall consist of seven members, all of whom -sAaU reside~ <br />in, ovm property in, or or are enaaaed in business. which means ownina a business. oracticina a <br />orofession. or oerformina a service fer comoensation. or servina as an officer or director of a <br />corooration or other business entity so enaaaed. within the operate :1 business locatod 'Nithin the <br />area of operation of the Community Redevelopment Agency. In addition. an ex-offico. non-votina. <br />oosition is orovided for the Seminole County US 17-92 CRA Prooram Manaaer. <br /> <br />B. Four of the members of the CRA shall be nominated and appointed by the Casselberry City <br />Commission and three of the members of the CRA shall be nominated by the Board of County <br />Commissioners of Seminole County and appointed by the Casselberry City Commission, per City <br />Ordinance No. 02-1048. <br /> <br />C. A vacancy occurring during the term shall be filled for the unexpired term by the Commission <br />appointment in the same fashion as the original appointment. Reappointments following expiration <br />of a term of appointment shall also be filled in the same fashion as the original. <br />
