Pieski had built on Northshore property. <br /> <br /> <br />stated had built on the HOA property, not <br /> <br /> <br /> <br />asked if the <br /> <br /> <br />was <br /> <br /> <br />bcforc thc posts wcrc <br /> <br />Mr. Pieski stated no the property was not surveyed; he <br /> <br /> <br />Mr. Flint asked who built the wall. <br /> <br />Mr. Picski stated he built the wall. <br /> <br />Discussion. <br /> <br />Ms. Babb-Nutcher swore in Karen Swingle. <br /> <br />Karen Swingle, Northshore COUl1yard Villas, HOA President, gave testimony. She has been Prcsident for one <br />year following David Pieski who had been president the 2 years previous, and that Mr., Pieski had appointed <br />her president after him. Ms. Swinglc stated that the wali was built on the prope11y; the BOA has a ten <br />tract G, not an easement. The HOA has tract A,B,C,D,E,F, and G all of them, tract G happens to be access to <br />the lake. The fence Mr. Pieski stated he has pennission for, Ms. Swingle can show in the past official minutes <br />the HOA were they have requested for him to take it down. This was previous to her being president. <br /> <br />Mr. Wcekley asked if this is the tall wooden fence in the front. <br /> <br />Ms. Swingle stated it was the 6 foot one with the gate; it blocks otT access and creates other problems. <br /> <br />Discussion. <br /> <br />Ms. Swingle stated that legal action had been taken against sheds within the HOA, just prior to Mr. Picski <br />taking over the presidency. When Mr. Pieski took over he dismissed the legal action against sheds. Ms. Swingle <br />is currently \vorking with the HOA Attomey involving eleven different things. Ms. Swingles tcstimony <br />continued. The HOA has hired and attomey who asked for mediation, Mr. Pieski had not ackno\vledged the <br />attomey's request for 20 days, they then allowed for 30 days. Mr. Pieski had responded after the fact with a <br />letter to her, but never to the attomey. Testimony continued. The HOA has no objections to Mr. Pieski building <br />in his property; the HOA just wants access to their <br /> <br /> <br />Ms. Babb-Nutcher asked if technically no lawsuit has been filed. <br /> <br />Ms. Swingle stated that \vas correct, because they were looking for mediation, and <br />Enforcement hearing was coming up. <br /> <br />knew the Code <br /> <br />Ms. Babb-Nutcher askcd if there was any likelihood that the HOA vmuld transfer ownership of the land. <br /> <br />Ms. Swingle stated that they could not. This was looked into, because it's not an easement it's a tract. It's in <br />their documents the land could be sold to a utility company if needed. <br /> <br />Ms. Babb-Nutcher advised the board, this is not something that can be resolved in a 1-2 month pcriod. <br />
