He thcn stated that on 05/05/2008 ]\11r. Pieski <br />stated he wanted to go thru with the appeals process. Dr. Brock discussed this with staff' and it was detennined this <br />would go straight to City Commission; the next available meeting is 06/09/2008. <br /> <br />Ms. Babb-Nutcher asked if Mr. Picski has so many days to appeal the decision. <br /> <br />Dr. Brock statcd in the code it does not say. . Brock continued. <br /> <br />Discussion. <br /> <br />Dr. Brock stated Mr. Pieski has initiated the appeals process; this will be placed on the City Commission agenda for <br />06/09/2008. <br /> <br />Discussion. <br /> <br />Richard L. Henderson asked if the June date was in place of May 13,2008. <br /> <br />Discussion. <br /> <br />Dr. Brock stated the May 13th date is the date Mr. Pieski needed to indicate to <br />his decision. Mr. Pieski has already done this as of 05/05/2008. <br /> <br />City 'vvhether he wished to appeal <br /> <br />Robert C. Flint asked about a statement Dr. Brock has made, this case is no Building Pemlit, howevcr Dr. Brock <br />stated that Mr. Pieski did apply for a pel1nit but it was not in accordance. <br /> <br />Dr. Brock stated there are two different divisions, apparently the Building Pel111it had never been applied tor, but <br />did apply for a Construction Pem1it with Public Works last May. There are two separate processes in the City, <br />essentially a Construction Pem1it has to do with site work and a Building Pennit has to do with vel1ical <br />construction, some municipalities may require both for a sea wall. <br /> <br />Mr. Henderson asked so he is going to go t/uu the appeals proccss. <br /> <br />Dr. Brock stated yes, and, that if you were to tollow the time line in the letter written to the CEB, at that on <br />06/09/2008 the City Commission will decide whether to grant the variance or not. Dr. Brock continued. <br /> <br />Discussion. <br /> <br />Ms. Babb-Nutcher asked ifthere was any specific agreement regarding the Code Board Order that has already been <br />imposed or was there any suggestion that the Order would not go forward or not record the Order ifhe comes into <br />compliance with all Dr. Brock's dates. <br /> <br />Dr. Brock stated no. <br /> <br />Mr. Brown stated there was no agreement, but there was a request that the fine be suspended pending the outcome <br />of the appeal. <br />
