Mr. Henson made a motion to forward LPA 08-05 to the City Commission with a recommendation of approval based on staffs recommendations outlined in the staff memo dated May 8, 2008 from Ms. Smith to the Planning and Zoning Commission and modifying the distance separation from 5,000' to 2,500' of any residentially zoned district, or any retirement or assisted living facility for seniors. The recommendation is based on the "whereas clauses" in the ordinance. Mr. Weinroth seconded the motion. The Board was polled. Third Item of Business: Other Business. Ms. Smith stated that the electronic message board ordinance was approved by the City Commission as a complete prohibition of the signs. A general discussion ensued regarding containment of shopping carts within the shopping centers' property. Ms. Smith said there is nothing regulating existing retail stores; however, the new Wal- Mart will install a shopping cart containment system. A discussion ensued regarding code enforcement issues. Ms. Smith explained that code enforcement complaints can be submitted online. A discussion ensued regarding the location of a fence on a residential property located on South Winter Park Drive. Ms. Smith said she would forward the fence complaint to the Code Enforcement Department and she would also make a site visit.
