<br />ORDINANCE NO. 02-1051 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING PART II, <br />CHAPTER 26, ARTICLE II, SECTION 26-41, OF THE UNIFIED LAND DEVELOPMENT <br />REGULATIONS, ENTITLED "TERM OF LICENSE," ADDING A THIRD CATEGORY <br />FOR A LICENSE TERM FOR NEW LICENSE APPLICANTS, PROVIDING FOR A FEE <br />WAIVER, PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br /> <br />WHEREAS, it is the continuing desire of the City Commission of the City of Casselberry, Florida <br />to support, to the extent practicable, its local businesses and business owners; and <br /> <br />WHEREAS, there is ongoing problem in the administration of the occupational license fee tax <br />pursuant to Part II, Chapter 26, Article II, Section 26-41 of the City Code; and <br /> <br />WHEREAS, the strict application of Section 26-41, as noted above, also results in a high degree of <br />confusion and dissatisfaction on the part of new occupational license holders who start their business <br />in the months of August or September; and <br /> <br />WHEREAS, the strict application of Section 26-41, as noted above, results in unnecessary <br />administrative difficulties in the administration and application of the occupational licence fee tax for <br />new businesses; and <br /> <br />WHEREAS, other communities in Seminole County have addressed this problem in a manner that <br />is acceptable and consistent with good service to the business community; <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. Part II, Chapter 26, Article II, Section 26-41 of the City of Casselberry City Code be <br />amended as follows: <br /> <br />Section 3-10.9. Term oflicense. <br />(a) No license issued under this Article shall be issued for longer than one year. <br />All licenses shall expire on September 30, and license fees shall be payable on or <br />before October 1, unless otherwise specifically provided by this Article. <br /> <br />(b) Half-year licenses may be issued by the City under the provisions of this <br />Article for the period from April 1 to September 30, upon payment of one-half of <br /> <br />Ord. #02-1051.
