This instrument prepared by: Community Development Department City of Casselberry 95 Triplet Lake Drive Casselberry, Florida 32707 ORDINANCE 07.1231 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND USE MAP, ESTABLISHING THE FUTURE LAND USE MAP DESIGNATION OF INDUSTRIAL (I) FOR THE PARCEL AS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the property described in Section I is within the corporate boundary of the City of Casselberry; and WHEREAS, the Casselberry Planning and Zoning Commission/Local Planning Agency has held a publiC hearing with due publiC notice to consider this Comprehensive Plan Amendment; and WHEREAS, a Public Hearing on the question of amending the City of Casselberry Future Land Use Map designations of the property hereinafter described, has been duly held by the City Commission of the City of Casselberry, Florida, and at such hearing, interested parties and citizens for and/or against the proposed establishment of the City of Casselberry Future Land Use Map designation were heard; and WHEREAS, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held a public hearing to consider the Comprehensive Plan Amendment and has determined that the Future Land Use Map designation of said property provided in Section I, herein, shall be established as specified as that designation is defined in Future Land Use Element Objective FLU 1, as amended and supplemented, of the Comprehensive Plan of the City of Casselberry, Florida; and WHEREAS, such amendments are permitted, subject to the provisions of Chapter 163 of the Florida Statutes and Rule 9J-11 of the Florida Administrative Code. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry's Code of Ordinances, as amended and supplemented, said Chapter adopting the City of Casselberry's Comprehensive Plan, regulating and restricting the use of lands within the City of Casselberry, Florida, be, and the same is hereby amended to include property as Industrial, for the parcel of land located at the comer of Anchor Road and Oleander Way as follows: Parcell D#: Legal Description: Address: 08-21-30-511-0Doo-0010 LEG LOT 1 BLK D FERN PARK ESTATES PB 5 PG 11 380 Oleander Way and is hereby amended and given the Industrial Future Land Use designation as provided in Exhibit A.
