<br />This instrument prepared by: <br />Community Development Department <br />City of Casselberry <br />95 Triplet Lake Drive <br />Casselberry, Florida 32707 <br /> <br />ORDINANCE 07.1231 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND <br />THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE <br />OFFICIAL FUTURE LAND USE MAP, ESTABLISHING THE FUTURE LAND <br />USE MAP DESIGNATION OF INDUSTRIAL (I) FOR THE PARCEL AS <br />DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br /> <br />WHEREAS, the property described in Section I is within the corporate boundary of the City of <br />Casselberry; and <br /> <br />WHEREAS, the Casselberry Planning and Zoning Commission/Local Planning Agency has held a <br />publiC hearing with due publiC notice to consider this Comprehensive Plan Amendment; and <br /> <br />WHEREAS, a Public Hearing on the question of amending the City of Casselberry Future Land <br />Use Map designations of the property hereinafter described, has been duly held by the City Commission of <br />the City of Casselberry, Florida, and at such hearing, interested parties and citizens for and/or against the <br />proposed establishment of the City of Casselberry Future Land Use Map designation were heard; and <br /> <br />WHEREAS, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has <br />held a public hearing to consider the Comprehensive Plan Amendment and has determined that the Future <br />Land Use Map designation of said property provided in Section I, herein, shall be established as specified <br />as that designation is defined in Future Land Use Element Objective FLU 1, as amended and <br />supplemented, of the Comprehensive Plan of the City of Casselberry, Florida; and <br /> <br />WHEREAS, such amendments are permitted, subject to the provisions of Chapter 163 of the <br />Florida Statutes and Rule 9J-11 of the Florida Administrative Code. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry's Code of Ordinances, as <br />amended and supplemented, said Chapter adopting the City of Casselberry's Comprehensive Plan, <br />regulating and restricting the use of lands within the City of Casselberry, Florida, be, and the same is hereby <br />amended to include property as Industrial, for the parcel of land located at the comer of Anchor Road and <br />Oleander Way as follows: <br /> <br />Parcell D#: <br />Legal Description: <br />Address: <br /> <br />08-21-30-511-0Doo-0010 <br />LEG LOT 1 BLK D FERN PARK ESTATES PB 5 PG 11 <br />380 Oleander Way <br /> <br />and is hereby amended and given the Industrial Future Land Use designation as provided in Exhibit A. <br />
