ORDINANCE 08-1234 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF CASSELBERRY COMPREHENSIVE PLAN PURSUANT TO FLORIDA STATUTES, CHAPTER 163; PROVIDING FOR ADOPTION OF A TEXT AMENDMENT PROVIDING THE PUBLIC SCHOOL FACILITIES ELEMENT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the Florida Legislature intends that local planning be a continuous and ongoing process; and WHEREAS, the City Commission adopted the Comprehensive Plan, Ordinance No. 731 on February 17, 1992 and amended it upon adoption of Ordinance No. 773 on October 4, 1993; and WHEREAS, Section 163.3191, Fiorida Statutes, directs local governments to adopt needed amendments to ensure that the plan provides approprtate policy guidance for growth and development; and WHEREAS, the Planning and Zoning Board acting as the designated Local Planning Agency, reviewed several Growth Management issues, including the Public School Facilities Element, on July 11, 2007, held an advertised public hearing, provided for participation by the public in the process, and rendered ~s recommendations to the C~ Commission; and WHEREAS, The City Commission, on July 23, 2007, held an advertised public hearing for Ordinance 07-1217, provided for comments and public participation in the process in accordance with the requirements of state law and the procedures adopted for public participation in the planning process, and transmitted the Public School Facilities Element, Potable Water Element, Water Supply Facilities Work Plan, and 5 Year Capital Improvements Schedule 2007 - 2012 to the Department of Community Affairs (DCA) on September 1, 2007 for comment as part of the Large Scale Amendment Package DCA 07-1; and WHEREAS, the Department of Community Affairs has now reviewed the Public School Facilities Element, in addition to the other submitted text amendments and issued its Objections, Recommendations and Comments (ORC) Report on October 16, 2007; and WHEREAS, the Department of Commun~ Affairs has reviewed the 2007 Interlocal Aoreement for Public School Facilitv Plan nino and School Concurrencv for the Seminole Countv School District ("Aoreemenf') and issued a Notice of Intent (NOI) on December 12, 2007; WHEREAS, the City Commission previously adopted all the comprehensive plan amendments included in the Large Scale Amendment package DCA 07-01, except the Public School Facilities Element, during a Public Hearing and second reading for Ordinance 07-1217 on December 10,2007; and
