<br />RESOLUTION 08-1850 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />ENTER INTO THE AMENDED JANUARY 2008 INTER LOCAL <br />AGREEMENT FOR PUBLIC SCHOOL FACILITY PLANNING AND <br />SCHOOL CONCURRENCY BETWEEN SEMINOLE COUNTY, THE <br />SCHOOL BOARD, AND THE CITIES WITHIN SEMINOLE COUNTY TO <br />ENSURE COOPERATIVE PLANNING EFFORTS; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City entered into an Interlocal Agreement for Public School Facility Planning with the <br />County, School Board and Cities within Seminole County on April 29, 2003 to recognize a mutual obligation <br />for concurrent planning of development and school facilities; and <br /> <br />WHEREAS, the Florida Legislature amended Section 163.3180, Florida Statutes, in 2005 to mandate <br />the implementation of school concurrency; and <br /> <br />WHEREAS, the Planning and Technical Advisory Committee (PTAC) has worked co-operatively to <br />develop the 2007 Interlocal Agreement for Public School Planning and School Concurrency that addresses <br />the mandates of the Florida Legislature regarding school concurrency issues and the interests of the School <br />Board, Seminole County and the Cities; and <br /> <br />WHEREAS, the City Commission adopted the 2007 Interlocal Agreement for Public School Planning <br />and School Concurrency by Resolution 07-1822 on September 24, 2007 as a sound planning tool based on <br />generally accepted planning practices and principles that serves to further govemmental coordination; and <br /> <br />WHEREAS, the Department of Community Affairs issued Notice of Intent (NOI) stating the <br />Agreement is inconsistent with the minimum requirements of FS Chapter 163; and <br /> <br />WHEREAS, the PTAC has worked with the Department of Community Affairs and the Department of <br />Education to resolve the erred inconsistencies within the 2007 document and have developed the Amended <br />January 2008 Interlocal Agreement for Public School Planning and School Concurrency; and <br /> <br />WHEREAS, the City Commission has determined that the revised agreement addressed the <br />concerns of the Department of Community Affairs Notice of Intent. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission authorizes the Mayor to execute the "Amended January 2008 <br />Interlocal Agreement for Public School Planning and School Concurrency", attached as Exhibit "A", <br />
