<br />WHEREAS, the Seminole County Board of County Commissioners has, by resolution; <br />delegated the right and authorization to exercise powers as described and provided in Chapter 163, <br />Part III, Florida Statutes, such powers to include the authorization of a Community <br />Redevelopment Agency; as part of the Municipal public body or taxing authority; and <br /> <br />WHEREAS, the City desires to proceed under Part III, Chapter 163, Florida Statutes, to <br />establish the necessary means by which redevelopment can be accomplished in the Area; and <br /> <br />WHEREAS, all prerequisites having been accomplished, it is now appropriate and <br />necessary in order to proceed further that a Community Redevelopment Agency be created; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA: <br /> <br />SECTION 1. The City Commission does hereby expressly authorize the Community <br />Redevelopment Agency, pursuant to Section 163.356, Florida Statutes, which shall be a public <br />body, corporate and politic, and constitute a public instrumentality. <br /> <br />SECTION 2. The City Commission does hereby expressly authorize the Community <br />Redevelopment Agency to exercise all the powers conferred, and as limited, by Part III, Chapter <br />163, Florida Statutes, necessary or convenient to carry out and effectuate the purposes of <br />community redevelopment within the boundaries of the Community Redevelopment Area, more <br />particularly described in Exhibit "A", attached hereto. <br /> <br />SECTION 3. The City Commission does hereby expressly establish a Board of <br />Commissioners of the Community Redevelopment Agency (CRA), which shall consist of five <br />members, all of whom shall either reside in, own property in, or operate a business located within <br />the area of operation of the Community Redevelopment Agency. The members of the CRA shall <br />be nominated and appointed by the Casselberry City Commission. <br /> <br />SECTION 4. The terms of office of the members of the Community Redevelopment <br />Agency shall be 3 years, except that three of the members of the first appointed Board shall serve <br />terms of 1,2, and 3 years, respectively, from the date of their appointments. The names of these <br />three members shall be randomly selected by the City Commission. Thereafter, all members shall <br />serve terms of 3 years. A vacancy occurring during the term shall be filled for the unexpired term <br />by the Commission appointment in the same fashion as the original appointment. Reappointments <br />following expiration of a term of appointment shall also be filled in the same fashion as the <br />original appointment. <br /> <br />SECTION 5. Saving Clause. By approval of this Ordinance No. 95-851, the City <br />Commission of the City of Casselberry, Florida, does not grant to Seminole County, Florida, the right <br />to utilize any incremental increase in ad valorem taxes derived from real properties located within the <br />territorial limits of the City of Casselberry, Florida, for any purpose without the express approval of <br />the City Commission of the City of Casselberry, Florida, at a duly called public hearing. <br /> <br />Ord. 95-851 <br /> <br />2 <br />
