<br />Casselberry City Commission <br />December 10, 2007 Agenda <br />Page 2 <br /> <br />- Damon Chase, Esquire - Legal services performed in the CIP vs. City of Casselberry Quiet Title Suit <br />This item seeks Commission approval to issue payment in the amount of$3,360.00, or one-third the total fee, to the court- <br />appointed attorney, Damon Chase, for legal services performed in a lawsuit filed by Casselberry Investment Properties <br />against Altamonte and Fern Park Cemetery, Inc. and the City of Casselberry. <br /> <br />9. PUBLIC HEARINGS: The purpose ofa Public Hearing is to receive input regarding the item being considered. <br />Public Hearings are not intended to be a time for the public to obtain information about the subject matter of the hearing. <br />(Hearing Sequence: 1" - Staff; 2"' - Applicant/Requesting Party; 3" - Public; 4"'- Opportunity for brief rebuttals, if <br />appropriate; final - City Commission motion, discussion and action.) <br /> <br />A. Ordinance 07-1217 - Large Scale Amendment to the Comprehensive Plan (LPA 07-12) <br />Approval to adopt the revised 5-Year Capital Improvements Schedule 2007-2012, Water Element and the Water Supply <br />Facilities Work Plan, is requested. <br /> <br />B. Resolution 07-1847 - Fire Assessment Fee <br />Approval that the City intends to Use a Uniform Method of Collecting Non-Ad Valorem Assessments for the implementation <br />of a fire protection services assessment fee is requested. <br /> <br />C. Resolution 07-1848 - Street Lighting Assessment Fee <br />Approval that the City intends to Use a Uniform Method of Collecting Non-Ad Valorem Assessments for the <br />implementation of a street lighting assessment fee is requested. <br /> <br />10. FIRST READING OF ORDINANCES: <br /> <br />A. Ordinance 07-1231- Small Scale Future Land Use Amendment, LPA 07-07 - 380 Oleander Way <br />Approval to amend the Future Land Use Map classification from Seminole County Industrial to City of Casselberry Industrial <br />on the subject property previously annexed on October 22, 2007 is requested. <br /> <br />B. Ordinance 07-1232 - Zoning Map Amendment, ZB 07-04 - 380 Oleander Way <br />Approval to amend the Official Zoning Map classification from Seminole County C-2 to City of Casselberry I (Industrial) on <br />the subject property previously annexed on October 22, 2007 is requested. <br /> <br />II. RESOLUTIONS: <br /> <br />A. Resolution 07-1849 - Conservation Easement to Sl. Johns River Water Management District as Relates <br />to the North Winter Park Drive Realignment Project <br />Approval of a conservation easement consisting of a 10.20 acre site, located west of the existing North Winter Park Drive and <br />south of the City's Water Reclamation Facility, to satisfy the requirements related to permitting for the North Winter Park <br />Drive Realignment project is requested. <br /> <br />12. OTHER ITEMS: <br /> <br />A. Fire Station Mold Issues - Request to Litigate <br />Approval to litigate against the contractor, Rowan South Construction, Inc., for inferior work which resulted in the need for <br />mold remediation work at Fire Station 21 is requested. <br /> <br />B. WaiverlReduction of Code Enforcement PenaltieslLiens - CE-07-00724 ($2,800.00) - 2370 Winter <br />Woods Blvd., Casselberry; Owner - Navy Federal Credit Union <br />Consideration to reduce the outstanding lien from $2,800.00 to $1,000.00 is requested. <br /> <br />C. WaiverlReduction of Code Enforcement PenaltieslLiens - CE-07-0065 I ($2,800.00) - 1755 SR 436, <br />Casselberry; Owner - Navy Federal Credit Union <br />Consideration to reduce the outstanding lien from $2,800.00 to $1,000.00 is requested. <br /> <br />D. Site Plan Approval for Centex Homes, Legacy Park Phase 3, SPR 07-16 <br />Approval for construction of Phase 3 of the Legacy Park Development, with modification to the length ofthe driveways, is <br />requested. <br /> <br />13.
