SECOND READING OF ORDINANCE 02-1044 - CABLE FRANCHISE <br />AUTHORITY <br /> <br />MOTION: <br /> <br />Commissioner Clark moved to read Ordinance 02-1044 <br />by title only. Motion was seconded by Commissioner <br />Henson. Motion carried unanimously by voice vote. <br /> <br />The City Clerk read Ordinance 02-1044 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, SEMINOLE COUNTY, <br />FLORIDA, ESTABLISHING A FRANCHISE ORDINANCE FOR CABLE <br />COMMUNICATIONS SYSTEMS; PROVIDING PROVISIONS FOR INTENT AND <br />PURPOSE, DEFINITIONS, CONFLICTING PROVISIONS, USE OF STREETS, GRANT <br />OF AUTHORITY, FRANCHISE REQUIREMENTS, FRANCHISE CHARACTERISTICS, <br />FRANCHISE SUBJECT TO OTHER LAWS, INTERPRETATION OF FRANCHISE <br />TERMS, GRANT OF FRANCHISE, COMPLAINTS, RATES, INDEMNIFICATION, <br />FRANCHISE AREA, FRANCHISE FEE, MAPS, REPORTS AND RECORDS <br />DISCRIMINATIONS PROHIBITED, WAIVER, TAXES, TRANSFERS, APPLICATION <br />FOR GRANT, REMOVAL, MODIFICATION, OR TRANSFER OF FRANCHISE, <br />MINIMUM FACILITIES AND SERVICES, ACCESS CHANNELS AND FACILITIES, <br />MINIMUM CUSTOMER SERVICE STANDARDS, CUSTOMER COMPLAINTS, <br />RENEWAL OF FRANCHISE, CITY RIGHTS, FRANCHISE RULES, PERFORMANCE <br />BOND, SECURITY FUNDS, SUBSCRIBER PRIVACY, TECHNICAL STANDARDS, <br />ENFORCEMENT REMEDIES, REVOCATION OF FRANCHISE, PENALTIES, <br />PROCEDURES, CONTINUITY OF SERVICE MANDATORY, PERFORMANCE <br />EVALUATION, ADMINISTRATION, PERSONAL LIABILITY, APPLICABILITY, <br />TIMELINESS BY FRANCHISEE; AND PROVIDING FOR CODIFICATION, <br />SEVERABILITY, CONFLICTS AND AN EFFECTIVE DATE." <br /> <br />The Notice of Public Hearing relative to Ordinance 02-1 044 was published in the Orlando Sentinel on March <br />14, 2002. Ordinance 02-] 044 was passed on first reading on February II, 2002. <br /> <br />Mayor Pronovost asked if there was anyone in the audience that wished to speak either for or against <br />Ordinance 02-1044. No one came forward. Mayor Pronovost closed the public hearing. <br /> <br />MOTION: <br /> <br />Commissioner Clark moved to approve and adopt <br />Ordinance 02-1044 on second and final reading as <br />presented. Motion was seconded by Commissioner <br />Henson. Motion carried unanimously by roll call vote. <br /> <br />Roll Call Vote of the City Commission: <br /> <br />Commissioner Sheppard - Yes; Commissioner Clark - Yes; Commissioner Henson - Yes; Vice <br />Mayor Hart - Yes; Mayor Pronovost - Yes.
